RESOLUTION NO. 1769
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, CALIFORNIA, RECOMMENDING
APPROVAL OF TENTATIVE TRACT 10495 TO THE
CITY COUNCIL.
The Planning Agency of the City of Tustin does hereby resolve as follows:
1. The Planning Agency finds and determines as follows-
a. That a proper application was filed by the Robert P.
Warmington Company pursuant to Ordinance No. 651
(as amended) for the purpose of creating 4 commer-
cial lots and two residential lots with five common
area lots related to residential development along
the easterly side of Newport Avenue, 100' southerly
of Irvine Boulevard.
b. That the proposed map is in conformance with the
Tustin Area General Plan.
c. That an EIR has been certified for the above project
'(EiR 77-4) and is in the process of being amended.
2. The Planning Agency hereby recommends to the City Council the
approval of Tentative Tract 10495 subject to the following
conditions'
a. Prior to recordation of the maD, water improvement
plans shall be approved by the Fire Warden for
fire protection and financial security posted for
the installation. The adequacy and reliability
of %,jater system design, location of valves, and
distribution of fire hydrants will be evaluated
in accordance with Public Utilities Commission
(PUC), General Order 103.
b. Prior to filing application for building permits
for combustible construction, evidence that water
supply for fire protection is available' shall be
submitted to the County Fire Warden.
c. Prior to application for building permits on any
portion of the map served by private streets not
shown on the map, a site plan showing building
locations and private drive arrangement shall be
approved by the Fire Warden.
d. Annexation of any portion of the map to the Tustin
Lighting District that is not presently included
within the Tustin Lighting District. Proof of
application to the County Surveyor's Office will
be required prior to the final approval of the map
by the City Engineer.
e. Dedication of all public street right-of-way as
required by City Engineer.

f. Preparation of street improvement drawings to
include but not limited to such improvements
as street paving, curb and gutter, sidewalk,
drive aprons, street trees, median islands,
sewer, water, street lights, storm drains,
signing and striping as required by the City
Engineer.
g. Submission and approval of a drainage and
grading plan for the entire site.
h. Installation of marbelite lights with under-
ground conduit along Newport Avenue.
i. Installation of street trees per the City's
Master Plan along Newport Avenue.

:,.rater improvements for each lot requiring such

k. Provision for a fire department access ease-
ment between Street "A" and Lot "C" adjacent
to the southerly boundary of the map.
i. S~,.~t;-o~' "A" shall be 40 feet between curbs, in
lieu of 36 feet and 8 foot parkways in lieu
of 10 feet.
m. Revision of the Newport Drive access, Street
"A" access to commercial lots and access to
condominium lots to the requirements of the
City Engineer.
n. Recordation of permanent access and parking
easements for the four commercial lots.
o. Installation of all electrical and telephone
utilities .underground with no new overhead
poles being set either on or adjacent to the
subject development.
p. Approval of all CC & R's for the two condo-
minium lots and five common area lots and
inclusion of a reciprocal access agreement
between Lots 3 and 4 and Lot "A", all to be
approved by the City Attorney.
q. Conformance to all'previously approved specific
plans (as revised) and conditions set forth in
the EIR for .the entire project, and 'i:ncluding
all off-site work adjacent to the Builder's
Emporium parking lot.
r. Adequate protection to the fuel line as determined
by the owners of the facility and the City
within the public street right-of-way.
s. Newport median island to be modified per Exhibit
"A".
