RESOLUTION NO. 1763
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN GRANTING A VARIANCE TO VARY
FROM R-3 DISTRICT ZONING REGULATIONS AT
525 SOUTH "B" STREET
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as follows:
a.
That a proper application for Variance (No. 78-5)
was filed on behalf of Ronald C. Webber for a
variance to permit construction of an apart-
ment building on an R-3 (multiple-family) lot
of substandard width (50'), on the property
described in Exhibit "A" attached hereto and
incorporated herein by this reference, as
though set forth herein in full.
b. That a public hearing was duly called, noticed
and held on said application.

That because of special circumstances applicable
to the subject propertyt relative to size,
shape, topography, location or surroundings, a
strict application of the Zoning Ordinance is
found to deprive the subject property of
privileges enjoyed bv other properties in the
vicinity and under i~entical-zone classifica-
tion, evidenced by the following findings:
(1) The use in conformance with the Land Use
Element of the Tustin Area General Plan.
(2)
Ail other provisions of the R-3 zoning
requirements can and will be satisfied.
(3)
The lot was sub-divided prior to the enact-
ment of the R-3 development provisions.
d.
That the granting of a variance as herein
provided will not constitute a grant of special
privilege inconsistent with the limitations upon
other properties in the vicinity and district
in which the subject property is situated.
e.
f.
That the granting of the variance as herein
provided will not be contrary to the intent of
the Zoning Ordinance or the public safety,
health and welfare, and said variance should
be granted.
Proposed development shall be in conformance
with the development policies adopted by the
City Council, Uniform Building Official, Fire
Code as administered by the Fire Chief, and
street improvement requirements as administered
by the City Engineer.

g. Final development plans shall require the
review and approval of the Community
Development Director.
2. The Planning Agency hereby grants a variance as
applied for, to permit construction of an apartment building
as applied for subject to the following conditions:
a. Submittal of final development plans with
revision as recommended bv staff.

b. Installation of street improvements, to include
street lights, and payment of related fees as
recommended by the City Engineer.
c. Ail required garages shall be maintained free
and clear of all materials at all times so as
to accomodate the vehicles for which they were
designed and rental agreements and leases shall
contain provisions so requiring.
PASSED AND ADOPTED at a regular meeting of the Planning
Agency of the City of Tustin, California, held on the 17th
day of July, 1978.
