HomeMy WebLinkAboutPC RES 1762 1 3 4 § 6 ? 8 9 10 11 12 13 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 3O 31 32 RESOLUTION NO. 1762 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN GRANTING A USE PERMIT APPLICATION NO. 78-15, RALPH'S GROCERY COMPANY The Planning Agency of the City of Tustin does hereby resolve as follows: 1. The Planning Agency finds and determines as follows: a. That a proper application (Use Permit No. 78-15) was file~ on behalf of Ralph's Grocery Company for a Use Permit to allow a 2990 square foot eXPansion to the existing Ralph's Grocery Store in conjunction with the elimination ok a potential gas station from the site plans. Subject property is located on the northeast corner of 17th Street an~ Carroll- Way. b. That a public hearing was duly called, noticed and held on said applicatiOn. c. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort' or general welfare of the person residing or working in the neighborhood of such proposed use, evidenced by the following findings: (1) That the site is presently being utilized as a shopping center. (2) The exterior elevations of the building addition will be in harmony with the existing center. (3) That additional planting and site improvements will accompany the building expansion. (4) That said development is in conformance to the' Tustin General Plan. d. That the establishment, maintenance and operation of the use applied for will not be injurious or the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e. Proposed development shall be in accordance with the develop- ment policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. f. That the project is categorically exempt from environmental impact reporting requirements. 2. The Planning Commission hereby grants a Use Permit as applied for, to authorize an expansion, 18.69 feet x 160 feet (2990 square) to an existing Ralph's Grocery Store in conjunction with the elimination of a potential gas station location from the site plans subject to the following conditions: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 1762 Page Two July 17, 1978 a. That final development plans be submitted for staff review and approval to include landscape and building materials, .. irrigation, and plot plans. . b. That the development of the subject property shall be done in conformance with all applicable codes and standards, to include the City of Tustin Development Standards, the Zoning- Ordinance (Ord. 157), and the Sign Ordinance (Ord. 684). c. That the owner shall present to the City an irrevocable offer of dedication of a 10 foot wide strip of land adjacent to 17th Street and a sufficient corner radius to permit an 8 foot sidewalk as measured from the curb face. Developer shall also furnish the City with a legal description for such dedication and 8%" x 11" sketch of said dedication. d. That use~of the rear of the market for storage without sufficient screening is prohibited. e. That the corrugated metal storage structure at the rear of the market shall be removed or replaced with a decorative masonry enclosure.
