HomeMy WebLinkAboutPC RES 17521 2 3 4 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 3O 31 32 RESOLUTION NO. 1752 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN RECOMMENDING TO THE CITY COUNCIL DISPOSITION OF SURPLUS ROAD RIGHT- OF-WAY EXCESS LAND NOT REQUIRED FOR STREET PURPOSES The Planning Agency of the City of Tustin does hereby resol% as follows: 1. The Planning Agency finds and determines: // a. That a proper application was reGUlarly initiated by the Planning Agency for the ourpose of determininq the needs, if any, of a parcel of land described as the southerly half of Lot 12 in Block "B" of "Martin's Addition to the Town of T~]stin City," as per map thereof recorded in Book 19, page 79, of Miscellaneous Records of Los An¢.~eles County, California, excepting therefrom the northwesterly 20.00 feet thereof. b. That the subject property was acquired as part of ~103-292 25 alo~ a parcel of land designated as A.P. r - the easterly side of Newport Avenue for street widening, the whole of which was purchased in order to avoid excessive severance damages. c. That a public hearing was duly cai!ed, noticed, and held on the proposal to dispose of said property . d. That the subject property is and should be declared excess to the City's needs a~d disposed of for pri- vate development for the following reasons: 1) The property is not suitable nor adequate for any other public purpose, such as parks or recreational needs. 2) There is no contemplated use of the property for public right of way, either presently or prospectively. 1 4 § 6 8 9 10 11 12 15 14 15 16 17 18 19 e. That a sale of the subject property is in conformance with the General Plan of the City of Tustin. f. That the sale of the property would be in the City's interest and that a value has been placed on said property by City consultant appraisers of $ 2.03 per square foot or $ 5,500.00 total and that a minimum bid price in that amount should be set. g. That the sale of the subject property qualifies as a class 12 categorical exemption from an Environmen- tal Impact Report as set out at Title 14 of the California Administrative Code Section 15112. 2. The Planning Agency, pursuant to Sections 37350 and 65402 of the Government Code,.hereby recommends to the City Council the declaration of the subject parcel as excess to the needs of the City and its disposition by sale. o PASSED AND ADOPTED as a regular meeting of the Planninq Agency, held on the 15th day of May , 1978. 20 21 22 ATTEST: 24 25 28 29 ~0 32 ....
