RESOLUTION No. 1743
THE PLANNING AGENCY OF THE CITY OF TUSTIN
AUTHORIZING REDEVELOPMENT OF A SELF-SERVICE
GASOLINE STATION AT THE WESTERN CORNER OF
NEWPORT AVENUE AND MITCHELL AVENUE (14121
NEWPORT AVENUE)
The Planning Agency of the City of Tustin does hereby resolve as
follows:
1. The Planning Rgency finds and determines as follows:
a. That a proper application, Use Permit No. 78-8 was filed
by Clyde Carpenter & Associates on behalf of Arkin, Inc.
(dba, Thrifty Oil Company) for authorizat, ion to demolish
and reconstruct a self-service gasoline station at the
property located on the western corner of Newport Avenue
and Mitchell Avenue as provided in Section°'9232b(k) of the
Tustin City Code. ~
b. That a public hearing was duly called, noticed and held
on said application;
c. That establishment, maintenance and operation of the use
applied for will not, under the circumstances of this
case, be detrimental to the health, safety, morals,
comfort or general welfare of the persons residing or
working in the neighborhood of such proposed use, evidenced
by the following findings:
1. The proposed use is in conformance with the Land Use
Element of the Tustin Area General Plan.
2. The proposed use is in conformance with the Zoning
Ordinahce (C-l).
d. That the establishment, maintenance and operation of the
use applied for will not be injurious or deterimental to
the property and improvements in the neighborhood of the
subject property, nor to the .general welfare of the City
of Tustin, and should be granted.
e. Proposed development shall be in accordance with the
development policies adopted by the City Council, Uniform
Building Codes as administered, by the Building Official,
Fire Code as administered by the Fire Chief, and street
improvement requirements as administered by the City
Engineer.
f. Final development plans shall require the review and ap-
proval of the Development Preview Commission.
g. A Negative Environmental Impact Declaration has been
granted for the development by the Community Development
Director.
2. The Planning Agency hereby, grants a'-Conditional Use Permit,
as applied for, to allow construction and redevelopment of a self-service
gasoline station as requested subject to the following conditions:

a. The construction of any missing or damaged street improve
ments on Newport Boulevard and Mitchell Avenue frontages
per City of Tustin "Minimum Design Standards for Public
Works" and "Street Improvement Standards." A plan
prepared by a civil engineer shall be submitted showing
this work which shall consist of, but not be limited to,
sidewalk street trees, street light, sewer and water
laterals, fire hydrant and drive aprons.
b. The public improvements to be constructed in conjunction
with this project shall be completed prior to the issuanc
of a "Certificate of Occupancy."
c. Payment of sewer connection fee per Orange County
Sanitation District No. 7 ordinance.
d. Shrubbery along street frontages shall be maintained no
higher than 30 inches above the adjacent payment. Trees
shall be kept trimmed at maturity to a height of 5'.
e. The proposed aisle along the southwesterly property line
shall be a minimum of 16 feet wide.
f. Payment of $45.00 per tree to the City for the planting
of street trees at 40 feet on center.
g. The easterly drive approach on Mitchell shall be closed
and a perimeter planter provided along the property line.
h. A trash enclosure with view and obscurring gates shall
be provided.
i. Landscaping and irrigation plans shall be submitted for
review to provide the following plant material quantities
13 - 15 gal. trees
3 - 24" box trees, plus required street trees.
j. A 6'-8" high decorative masonry wall shall be provided
along the~western property line.
k. Outside storage or display'of products is strictly pro-
hibited. Repair work on vehicles is prohibited.
1. Signing shall be limited to:
1. One (1) 42 sq. ft. combination business identificatio
and price pole sign, not to exceed the height of the
structures. A decorative pole cover shall be provide~
2. Driveway directional signs of 6 sq. ft. in area, four
(4) maximum heights as provided in sign ordinance.
3. One cashier wall sign of nine (9) square feet.
4. Temporary pricing and advertising sign are strictly
prohibited except as authorized in provisions of the
Sign Code.
