A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN AMENDING USE PERMIT 76-14 FOR
THE COURTYARD SHOPPING CENTER
The Planning Commission of the City of Tustin does hereby resolve as
follows:
1. The Planning Commission finds and determines as follows:
a. That a proper application (Use Permit #78-4) was filed on
behalf of Courtyard Associates for the purpose of amending
Use Permit 76-14 to authorize a 5,400 sq. ft. Coco's
Restaurant on a site previously authorized for a 5,000 sq. ft.
building located in the Courtyard.
b. That a public hearing was duly called, noticed and held on said
application;
c. That establishment, maintenance and operation of the use
applied for will not, under the circumstances of this case,
be detrimental to the health, safety, morals, comfort or general
welfare of the persons residing or working in ~the neighborhood
of such proposed use, evidenced by the following findings:
1. The subject use is in conformance with the Tustin Area
General Plan as adopted by the City Council.
2. The restaurant will be constructed in accordance with
the approved plans which will create a landscaped buffer
between the restaurant and the bank.
d. That the establishment, maintenance and operation of the use
applied for will not be injurious or detrimental to the
property and improvements in the neighborhood of the subject
property, nor to the general welfare of the City of Tustin, and
should be granted.
e. Proposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
administered by the Building Official, Fire Code as administered
by the Fire Chief, and street improvemenet requirements as
administered by the City Engineer.
f. Final development plans shall require the review and approval
of the Community Development Director.
g. An EIR was previously certified for this project.
2. The Planning Agency hereby grants a Use Permit, as applied for, to
allow for a 5,400 sq. ft. restaurant and an additional sign for the Courtyard
shops to be located on the court trelis subject to the following conditions:
a. Signing shall be in conformance with the approved master sign
plan and with provisions of the Sign Code. Signing area for the
Courtyard pole sign identification shall not exceed:
1. one in number .. ':i..~' .. ~..
2. 50 sq. ft. in.area "
3. Final plans to be approved by'Community D~velopment~Dire~tor
b. Restaurant signing shall be in conformance with the approved
master sign plan and with the provisions of the Sign Code as
administered by the Community Development Director.

c. The final development plans to include plot, elevations,
materials, landscaping, irrigation, lighting, and signing
shall be submitted for review and approval by staff, in
accordance with the concepts of the approved preliminary
plans.
d. Installation of all utilities underground, with no addition
of overhead poles to be set within the property or adjacent
to the street right-of-way.
e. Installation of the street improvements to the satisfaction
of the City Engineer and conformance to the design criteria
as contained in the City of Tustin development standards
(Resolution 76-23).
f. Conformance to the requirements of the Fire Department as ·
related to the location of fire hydrants and sprinkler systems.
g. The approval of the Redevelopment Agency prior to the issuance
of permits.
PASSED AND ADOPTED at a regular meeting of the Planning Agency of the
City of Tustin, California, held on the 17th day of April, 1978.
