RESOLUTION NO.1736
A RESOLUTION OF THE PLANNING AGENCY OF
THE CITY OF TUSTIN AMENDING USE PERMIT
'76-25 FOR LARWIN SQUARE
The Planning Agency of the City of Tustin does hereby resolve
as follows:
1. The Planning Agency finds and determines as follows:
a. That a proper application (Use Permit 78-5) was
filed by Michael Gesler & Associates for the purpose
of amending Use Permit 76-25 to authorize a 5,000
sq. ft. restaurant on a site previously authorized
for a 4,634. sq. ft. building located in Larwin Square
b. That a public hearing was duly called and noticed on
said application.
c. That establishment, maintenance and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, mora
comfort or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
1. The subject use is in conformance with the Tusti.
Area General Plan as adopted by the City Council.
2. The restaurant will be constructed in accordance
with the approved plans for the building with
architectural features to conform with the Spanis~i
Mediterranean theme o.f Lgrwin Sqmare.
d. That the establishment, maintenance and operation of
the use applied for will not be injurious or detri-
mental to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin, and should be
granted.
e. Proposed development shall be in accordance with the
development policies adopted by the City Council,
Uniform Building Codes as administered by the Buildin¢
Official, Fire Code as administered by the Fire
Chief, and street improvement requirements as
administered by the City Engineer.
f. That a Negative Declaration had previously been
approved for the Larwin Square Renovation.
g. Final development plans shall require the review and
approval of the Community Development Director
2. The Planning Agency hereby grants a Use Permit, as
applied for, to allow the construction of a 5,000 square foot
restaurant which will encroach 1.3 feet into the 15 foot setback,
subject to the following conditions:
a. The final development plans to include plot, eleva-
tions, materials, landscaping, irrigation, lighting,
and signing shall be submitted for review and approval
by staff, in accordance with the concepts of the
approved preliminary plans.

d.
Installation of all utilities underground, with no
addition of overhead poles to be set within the
property or adjacent to the street right-of-way.
Installation of the street improvements to the
satisfaction of the City Engineer and conformance
the design criteria as contained in the City of Tustinl
development standards (Resolution 76-23).
Conformance to the requirements of the Fire Department
as related to the location of fire hydrants and
sprinkler systems.
e. The approval of the Redevelopment Agency prior to the~
issuance of permits.
PASSED AND ADOPTED at a regular meeting of the Planning

Agency of the City of Tustin, California, held on the 17th day of
April, 1978.
