RESOLUTION NO. 1734
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN APPROVING USE PERMIT 78-3
AUTHORIZING A SELF-SERVE GASOLINE PUMP
ISLAND AT 16471 MCFADDEN AVENUE
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as follows:
a.
That a proper application, Use Permit 78-3,
was filed by Ron Price Enterprises, Inc. to
request authorization to construct and operate
a self-serve gasoline pump in conjunction with
an existing food and liquor store at the north-
west corner of McFadden Avenue and Williams
Street.
b. That a public hearing was duly called, noticed
and held on said application;

That establishment, maintenance and operation
of the use applied for will not, under the
circumstances' of this case, be detrimental to
the health, safety, morals, comfort or general
welfare of the persons residing or working in
the neighborhood of such proposed use, evidenceu
by the following findings:

The use is in conformance with land use
element of the general plan and the zoning
ordinance.
.
The use will expand the neighborhood
commercial services in the area.

That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.

Proposed development shall be in accordance with
the development policies adopted by the City
Council, Uniform Building Codes as administered
by the Building Official, Fire Code as
administered by the Orange County Fire Marshall,
and street improvement requirements as admin~
istered by the City Engineer.
The use will not pose significant environmental
impacts on the neighborhood and it is categoric-
ally exempt from environmental impact reporting
requirements.

Final development plans shall require the
review and approval of the Community Develop-
ment Director.
2. The Planning Agency hereby grants a conditional use
Permit, as applied for, to authorize construction and operation
of a self serve gasoline pump island subject to the following
conditions:

a. The owner shall present to the City an irrevocabl
offer to dedicate ten feet of right-of-way along
with a corresponding "corner radius" having a
sufficient radius to permit a minimum eight foot
sidewalk along McFadden Avenue.
b.
That the pump island shall be constructed at a
minimum of 15' from the ultimate right-of-way
line.

That perimeter plantersand repair of existing
planters shall be required as recommended by staff
Complete building, electrical, landscaping,
irrigation and sign plans shall be submitted to
the Community Development Department in accordanc
with existing development guidelines and
ordinances.
Gasoline pricing signs shall be limited to a
total of 10 sq. ft. in accordance with the
supplemental signing provisions of the Sign Code.
PASSED AND ADOPTED at a regular meeting of the Planning
Agency of the City of Tustin, California on the 3rd day of April, 1978
g. Annexation of the subject property into the
Tustin Lighting District.
