RESOLUTION NO. 1715
A RESOLUTION OF THE PLANNING AGENCY OF
TIlE CITY OF TUSTIN GRANTING A VARIANCE ON
APPLICATION NO. V 78-1 FOR DEVELOPMENT OF
MULTIPLE FAMILY RESIDENTIAL DISTRICT LOTS
OF SUBSTANDARD WIDTH WITH ZERO STRUCTURAL , ~ .;
SETBACK. : '
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as follows:
a. That a proper application for Variance No. 78--1
was filed by David L. Levinson for a variance
to permit construction of apartment units on fifty
foot wide lots in the Multiple Family Residential
District (R--3-2000) %.;ith zero sidelot setback.
On the properties described in Exhibit "A" attached
hereto and incorporated herein by this reference,
as though set forth herein in full. Located ah
1092 and 1102 San Juan Street.
b. That a public hearing was duly called, noticed and
held on said application.
c. That becJuse of special circumstances applicable
to the subject property, relative to size, shape,
topography, location or surroundings, a strict
application of the Zoning Ordinance is found to
deprive the subject property of. privileges enjoyed
by other properties in the vicinity and under
identical zone classification, evidenced by the
following findings:
1) the subject properties are within the correct
zoning classification for the proposed use
2) the proposal is in conformance with the Tustin
area General Plan.
d. That the granting of a 'variance as herein provided
will not constitute a grant of special privilege
inconsistent with the limitations upon. other pro-
perties in the vicinity and district in which the
subject property is situated.
e. That the granting of the variance as herein pro-
vided will not be contrary to the intent of the
Zoning Ordinance or the public safety, health and
welfare, and said variance should be granted.
f. Proposed development shall be in accordance with
the development policies adopted by the City
Council, Uniform Building Codes as administrered
by the Building Official, Fize Code as administered
by the Fire Chief, and street improvement require-
ments as administered by the City Engineer.
g. Final development plans shall require the revie%.;
and approval of the Community Development Director.

2. The Planning Agency hereby grants a variance as
applied for, to permit construction of fourplex apartment .units
as applied for subject to the following conditions: , ,.
1) Submission of street improvement plans prepared by
a civil engineer and subject to the approval of the
City Engineer and construction' of all missing Stree
improvements adjacent to this development per the
City of Tustin "Minimum Design Standards for Public
Works" and "Street Improvement Standards". This
work shall consist of but is not limited to:
a. curb and gutter and sidewalk
b. street and alley pavement
c. off-site work as may be required by the City
City Engineer to obtain positive street
drainage
d. marbelite street lights served with under-
ground conduit where required per Edison
Company requirements
e. sewer lateral connections.
2) Payment of sewer connection fees per Orange County
Sanitation District #7 ordinances.
3) Submission of a site grading plan.
