RESOLUTION NO. 1702
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN GRANTING A VARIANCE ON APPLICATION NO
V 77- 13 TO VARY WITH PROVISIONS OF SIGN ORDINANCE
NO. 684.
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as follows:
a) That a proper application for variance (No.
V 77-13 was filed on behalf of Lloyds Bank
for a variance to permit a six foot high
mounument sign to be located atop a five
foOt high planter at the northwest corner
of Newport Avenue and First Street .on the
property described in Exhibit "A" attached
hereto and incorporated herein by this
reference, as though set forth herein in
full.
b) That a public hearing was duly called, noticed
and held on said application.
c) That because of special circumstances appli-
cable to the-subject property, relative to
size, shape,.topography, location or sur-
roundings, a strict application of the
Zoning Ordinance is found to deprive the
subject property of privileges enjoyed by
other properties in the vicinity and
:under identical zone classification, evid-
enced by the following findings:
That the subject sign request is in con-
fommance with the intent of the Sign Ordinance
by its design compatibility with the proposed
bank building.
d) That the granting of a variance as herein
provided will not constitute a grant of
special privilege inconsistent with the
limitations upon other properties in the
vicinity and district in which the subject
property is situated.
e) That the granting of the variance as herein
provided will not be contrary to the intent
of the Zoning Ordinance or the public safety,
health and welfare, and said variance should
be granted.
f) Proposed~ development 'shall be in accordance
with the development policies adopted by the
City Council, Uniform B.uilding Codes as
administered by the Building Official, Fire
Code as administered by the Fire Chief, and
street improvement requirements as adminis-
tered by the City Engineer.

2. The Planning Agency hereby grants a variance as
applied for, to permit a six foot high monument sign located atop
a five foot high planter subject to the following conditions:
1. That the sign structure shall not interfere'
in any manner with the safe' use of the adjoin-
ing bike path.
2. That the ~recise location shall be as approved
by the City Engineer.
3. That the sign shall conform to all other
provisions of sign Ordinance NO. 684.
PASSED AND ADOPTED at a regular meeting of the Planning
Agency held on the 3rd day of January, 1978.
