RESOLUTION NO. 1696
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF
TUSTIN GRANTING A USE PERMIT ON APPLICATION U.P. 77-34,
FOR A POLE SIGN AT 12991 NEWPORT AVENUE.
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as follows:
a. That a proper application (U.P. 77-34) was filed
on behalf of De Miranda Management by Inovative
Graphics, Inc. for a Use Permit to allow construc-
tion of a center identification and tenant identifi-
cation pole sign located at 12991 Newport Avenue.
b. That a public hearing was duly called, noticed and
held on said application.
c. That establishment, maintenance and operation of the
use applied for will not, under the circumstances
of this case, be detrimental to the health, safety,
morals, comfort or general welfare of the persons
residing or working in the neighborhood of such
proposed use, evidenced by the following findings:
I. That the proposed use is a substantial reduction
in the nonconformity of existing signing at the
subject site.
II. That the proposal has been made in conjunction
with an improvement program for the shopping
center and is in substantial conformance with
development guidelines as adopted by the City
Council.
d. That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to the
general welfare'of the City of Tustin, and should
be granted.
e. Proposed development shall be in accordance with
the development policies adopted by the City Council,
Uniform Building Codes as administered by the Building
Official, Fire Code as administered by the Fire
Chief, and street improvement requirements as
administered by the City Engineer...
f. Final development plans shall require the review and
approval of the Community Development Director.
2. The Planning Agency hereby grants a Use Permit, as applied
for, to allow the construction of a combination center
identification and tenant identification sign of 96 square
feet, 24 feet in height at the subject location subject
to the following conditions:
a. That the sign shall be constructed in conformance with
nrovisions of Sign Ordinance #684.
b. That 48 square feet of the sign area shall identify the
existing Chinese restaurant and that this provision
is authorized in lieu of the existing restaurant pole
sign.

c. That the use of the portion of the sign by the
restaurant shall cease when a change in business
name is made as a result of a change of ownership.
At that time use of the total sign area shall be
by the shopping center owner for additional center
identification or for identification of all of the
tenants. Subject to a sign permit.
d. That no additional freestanding sign area or sign
structures are authorized for this site and all
existing freestanding signs must be removed prior
to issuance of a permit.
e. That tenants signs shall conform to the master
sign plan upon lease renewal, as approved by the
Community Development Director.
PASSED AND ADOPTED at a regular meeting of the Planning
Agency, of the City of Tustin, held on the 5th day of December,
1977.
