RESOLUTION NO. 1694
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN,
APPROVING USE PERMIT 77-33 FOR THE RESIDENTIAL PORTION OF
THE PACKERS SQUARE DEVELOPMENT.
The Planning Agency of the City of Tustin does hereby resolve
as follows:
The Planning Agency of the City of Tustin finds and determines
as follows:
a. That a proper application was filed by Harry Kassebaum,
3848 Campus Drive, Newport Beach, for a Use Permit to allow
the construction and operation of a Senior Citizens develop-
ment on the southerly side of Newport and Irvine Boulevard
known as Packers Square.
b. That a public hearing was duly called, noticed-and
held on said application.
c. That eStablishment and operation of the use, a Senior
Citizens complex will be of benefit to the community and not
detrimental to the health, safety and welfare of the adjacent
property owners and residents as evidenced by' the following
findings:
I. The proposed use is in conformance with the Land Use
Element of the General Plan and the zoning requirements
of the Planned Development District.
II. The key issues of concern brought out in EIR 77-4 have · been addressed and mitigated.
d. That the proposed development shall be in. full accordance
with all City standards and development policies adopted
by the City Council, Uniform Building Code, Fire Code
and street and public improvement requirements as admini-
stered by the Public Works Director.
2. The Planning Agency hereby grants a Use Permit, as applied
for, to allow the construction of a Senior Citizens complex
of 132 units subject to the following conditions:
a. Compliance with alI mitigating measures proposed by EIR
77-4.
b. Staff approval of final precise development plans, which
are also subject ot final Planning Agency review and approval
as per the requirements of 9224 C2 of the Planned Development
District Zone. Those requirements include, but are not limited
to, the following:
1. Fulfilling 50% open space.
2. Design and construction of street and parking improvements
according to the standards of the City Engineer.
3. Location of fire hydrants, alarms, drive way access and
smoke detectors according to requirements of the Fire Chief.
4. Review of all landscaping, building design, colors and
materials by the Community Development Department.
5. Site design, layout, building heights and arrangements.

6. Perimeter walls, landscaping and screening.
7. Off-site improvements for parking, drives and landscaping
on the adjacent Tustin Heights Shopping Center.
c. Recording of all reciprocal easements for ingress and
egress and parking to the adjacent parcels encompassed
in General Plan Amendment 77-2 (F).
d. Any revision in Senior Citizens complex concept whic%

or Citizens project shall ~equire the Use Permit
to be amended and reviewed to accommodate changes in
the following: Parking ratios and locations, building
design and sizes, site lay out, type and location of
recreational facilities, and all other areas of concern
affected by a change or modification in age group.
3. Building permits shall not be issued for the proposed structures
and uses authorized until the staff has reviewed and approved
all aspects of the precise development plan and the Agency
shall have granted their approval through final inspection.
PASSED AND ADOPTED at a regular meeting of the Planning Agency of
the City of Tustin, California, held on the 21st day of November, 1977.
