HomeMy WebLinkAboutPC RES 1690 1 2 4 5 17 ~0 g? RESOLUTION NO. 1690 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN GRANTING A USE PERMIT ON APPLICATION NO. U.P. 77-32, OF SGT. PEPPERONI'S PIZZA STORE. The Planning Agency of the City of Tustin does hereby_ resolve as follows: ~ 1. The Planning Agency finds and determines as fol lows: a) That a proper application (U.P. 77-32) was filed on behalf of Sgt. Pepperoni's Pizza Store for a Use Permit to allow for the operation of electronic games at the Pizza Store for the property located at 651 E. First Street, Suites C5 and C6 in the Courtyard Shopping Center. b) That a public hearing was'duly called, noticed and held on said application; c) That establishment, maintenance and operation of the use applied for will not, under the~ circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: The use is in conformance with the Tustin Area General Plan and the City of Tustin Zoning Ordinance. d) That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance with the Zoning Ordinance and the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. 2. The Planning Agency hereby grants a Use Permit, as applied for, to allow for the operation of electronic games, not to include pinball machines, in an area approximately 10' x 10' subject to the following conditions: a) The amusement area will be under constant supervision by the Sgt. Pepperoni Pizza Store. b) That the Use Permit can be revoked without a public hearing in the event of complaints of adjoining property owners or customers of the facility as a result of unsupervised activities, ! YI 1 I 2 and if the City Council finds the activity to be a nuisance upon recommendation of the Police Chief. PASSED AND ADOPTED at a regular meeting of the Planning Agency of the City of Tustin, California, held on the 7th day of November, 1977.
