PLANNING AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT ON APPLICATION FOR THE INSTALLATION OF DRIVE-THRU FAST FOOD FACILITY (U.P. 77-31). The Planning Agency of the City of Tustin does hereby resolve as follows' 1. The Planning Agency finds and determines as follows' A. That a proper application, Use Permit 77-31, was filed on behalf of Gordon Gray for a Use Permit to authorize the remodeling of the existing facility to include remodeling of the drive-thru service facility, additional signing and inside seat remodeling, for the property located at 245 East First~ Street. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the cir- cumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evi- denced by the following findings: (1). The use is in conformance with Tustin Area General Plan and the Zoning Ordinance. (2) The use is in keeping with the general character of commercial developments in the neighborhood. D. That the establishment, maintenance and opera- tion of the use applied for will not be injuri- ous or detrimental to the property and improve- ments in the neighborhood of the subject prop- erty, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the Zoning Ordinance and the development policies adopted by the City Council, Uniform Building Codes as administered by the 5uilding Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. 2. The Planning Commission hereby grants a Use Permit as applied for, to allow a drive-thru facility and alteration of an existing pole sign at 245 East First Street, subject to the following conditions: A. Continuous 6" Concrete curbing shall be pro- vided adjacent to parking stalls. B. Protective planters shall be provided adjacent to parking stalls which are bordered by drive aisles. C. The sign cabinet which advertises "Drive-Thru Service" shall be installed flush to the bottom of the existing identification pole sign. A decorative pole cover shall be added to the pole sign structure. 4 5 6 8 9 10 11 12 13 14 15 D. The installation of fluorescent light fixture along the top of the mansard roof is not aUth- orized for the improvements of the building. E. The "McDonald's" wall sign shall be placed on the roof facia line as it is presently installed on the existing building. F. That final development plans be submitted for staff review and approval to include plot, ele- vations, landscaping, irrigation, lighting, and signing plans. G. The entry area to the building for customers coming from the easterly parking lot shall incorporate those pedestrian safety devices deemed necessary by the Traffic Engineer. H.
