The Planning Agency finds and determines as follows: a. Tliat a proper application, pursuant to Ordinance #651, was filed by Hater Development Inc. for the purpose of creating a 14-lot subdivision. The property identified as being the southeasterly corner of Main and Williams. b. That an EIR was previously certified for this project (EIR 76-3). c. That the proposed map, design, and improvements are consistant with applicable general and specific plans. d. That the site is physically suitable for the type and the proposed density of development. e. That the design of the subdivision and/or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure any native flora or fauna. f. That the design of the subdivision and the type of improvements is not likely to cause serious public health problems. g. That the design of the subdivision and the type of improvements will not conflict with easements, acquired by the public at large, where access through or use of, property within the proposed subdivision. h. That the tentative tract map complies with all requirements of the City of Tustin subdivision Ordinance. i. 'Parkland in lieu fees shall be required in lieu of dedication of parkland in the amount of .45 acres of land X the full cash value of the land being developed, as determined by the latest equalized assessment roll. The Planning Agency hereby recommends to the City Council the approval of Tract #10029, subject to the following condi- tions: a. Installation of marbelite street lights served with underground conduit on all public street frontages. Also, provisions should be made to provide lighting on the private alley. All of the above subject to the approval of the City Engineer. b. This sidewalk easement area is 3.0 feet additional width on both sides over and above the right-of_- way shown on the revised tentative map. f. Traffic striping and signing as required and subject to the approval of the City Engineer on the interior street, t~illiarns Street and i`~Sairl Street. g. The design of the access to the private alley from the dead-end street shall meet tl~~e require- ments of and be subject to the approval of tli~` Tustin Fire Department. h. The formation of a homeowners association: or a co-operative agreement between Lots 1, 2,.3, 13, and 14 to provide for maintenance of the private alley and landscaping on tie i•iain Street frontage . • i. Payment . of park land dedication-in-lieu fees prior to the issuance of a building permit.
