A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN APPROVING USE PERMIT 77-29 AUTHORIZING
THE OPERATION OF A SANDWICH SHOP AT 2640 WALNUT AVE.

The Planning Agency of the City of Tustin does hereby
resolve as follows:

1. The Planning Agency finds and determines as follows:
a. A proper application (Use Permit 77-29) has been
filed on behalf of USA Sandwich Shop for the
operation of a take-out sandwich and salad shop
on a portion of Stewart's Tustin Business Center
on Walnut Avenue.
b. That a public hearing was duly called, noticed
and held on said application.
c. That establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental to the
health, safety or general welfare of the persons
residing or working in the neighborhood of such
proposed use, evidenced by the following findings:
1) That said development is in conformance to
the Tustin Area General Plan.
2) That perimeter landscaping has been provided
around the exterior of the complex, with
median planter islands in the interior drive
aisles.
3) That said devel'opment will be compatible with
the total master planned complex within
which the development is located.
d. That the establishment, maintenance and operation
of the use applied for will not be injurious nor
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.
e. Proposed development shall be in accordance with
the Zoning Ordinance and the development policies
adopted by the City Council, Uniform Building
Codes as administered by the Building Department,
the Uniform Fire Code as administered by the Fire
Department, and street improvement requirements as
administered by the City Engineer.
2. The Planning Agency hereby grants a Use Permit to
authorize the operation of a sandwich shop within the
Tustin Business Center as applied for, subject to the
following conditions:
a. Ail interior improvements shall comply with
applicable City building regulations.

b. Itours of operation shall be not earlier than
6:00 a.m. nor later than 7:00 p.m., Mondays
through Saturdays.
c. The primary business for the operation shall
be directed at'those working in and visiting
the Tustin Business Center. Promotion of the
facility for other than resident tenants shall
be a violation of the Use Permit.
d. The operation shall comply with Sign Ordinance
No. 684 and display a sign no larger than five
(5) square feet in conformance with a Master
Sign Plan for the Center.
e. Approval of the County Health Department shall
be required for food service facilities.
f. Seating capacity shall be limited to 16 seats.
PASSED AND ADOPTED at a regular meeting of the City of
Tustin Planning Agency, held on the 3rd day of October, 1977.
