RESOLUTION NO. 1674
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
'OF TUSTIN GRANTING A CONDITIONAL USE PERMIT ON
APPLICATION NO. U.P. 77-22, FOR THE CONSTRUCTION
OF A CENTER IDENTIFICATION POLE SIGN AT 380 EAST
FIRST STREET.
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as follows:
· A. That a proper application (No. U.P. 77-22)
was filed on behalf of Mr. John DeGennaro for
a Use Permit to authorize construction of a
shopping center identification pole sign, for
the property located at 380 East First Street.
B. That a public hearing was duly called, noticed
and held on said application.
C. That establishment, maintenance and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to
the health, safety, morals, comfort or general
welfare of the persons residing or working in
the neighborhood of such. proposed use, evidenced
by the following findings:
(1) That the proposal conformsto application
and permit procedures of Sign Ordinance
No. 684
(2) That the proposal is in conformance with
the Tustin Area General Plan.
D. That the establishment, maintenance and opera-
tion of the use applied for will not be injuri-
ous or detrimental to the property and improve-
ments in the n. eighborhood of the subject prop-
erty, nor to the general welfare of the City
of Tustin, and should be granted.
E. That the proposed development shall be in
accordance with the Zoning Ordinance and the
development policies adopted by the City Council
Sign Ordinance as administered by the Planning
Director, Uniform Building Codes as administered
by the Building official, Fire Code as admin-
istered by the Fire Chief, and street improve-
ment requirements as administered by the City
Engineer.
2. The Planning Agency hereby grants a Use Permit, as
applied for, to authorize installation of a shopping
center pole sign as indicated on said application,
subject to the following conditions:
A. That the total signing area allocated for all
of the present and future tenants shall not
exceed 48 square feet and the pole cover shall
not exceed 18" in width.

B. That the sign permit shall be applied for'on
behalf of the shopping center owner and that
he shall have control over the sign's use.
C. That the sign area is to be divided into three
(3) separate tenant identification signs and
at such time as when the fourth tenant, requests
freestanding identity the owner shall have
space made available within the 48 square foot
area.
D. No other freestanding signs are authorized
for the subject property.
E. The sign shall be .located no closer than five
feet (5') from the' front property line per
Sign Code provisions and to allow for adequate
traffic sight viSibi].ity.
F. That prior to the issuance of any permits, the
planters in the First Street parking lot must
be replanted with an appropriate groundcover
to staff's satisfaction.

G. That final construction plans and specifica-
tions will be submitted to the Building
Division for'review and approval.
H. That the removal of any trees due to construc-
tion must be replaced elsewhere on the site.
I. That each tenant of the shopping center shall
be provided with a copy of this resolution
by the owner.
PASSED AND ADOPTED at a regular meeting of the Planning
Agency of the City of Tustin held on the 6 th day of September,
1977.
