STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: RESOLUTION No. 12-23 APPROVING AND ADOPTING THE UPDATED ORANGE COUNTY REGIONAL WATER AND WASTEWATER MULTI-HAZARD MITIGATION (HAZMIT) PLAN SUMMARY A HAZMIT Plan is apre-disaster strategic plan written to identify mitigation actions that can reduce the impact of natural and manmade hazards such as fire, flood, earthquakes, landslides, etc. on critical water and wastewater facilities. Agencies with an approved HAZMIT plan become eligible to apply far Federal Emergency Management Agency {FEMA) grants, which can be used for emergency preparedness or response measures developed before and after disasters. RECOMMENDATION It is recommended that the City Council adopt Resolution 12-23 approving and adopting the Updated orange County Regional Water and Wastewater Multi-Hazard Mitigation {HAZMIT) Plan as it relates to Tustin Water Facilities. FISCAL IMPACT The approval of this Plan will maintain the City's eligibility to apply for State and Federal Hazard Mitigation funding for City water facilities should the funding become available. BACKGROUND The Federal Disaster Mitigation Act of 2000 (DMA 2K} required local agencies and states to develop Hazard Mitigation Plans to reduce risks to public facilities from natural hazards within their jurisdictions and authorized a program to fund mitigation projects. In 2004, The Federal Emergency Management Agency {FEMA} began restricting funding for hazard mitigation projects for any agency not covered by an approved Hazard Mitigation Plan. In 2006, the Orange County Regional Water and Wastewater Multi-Hazard Mitigation {HAZMIT} Plan was prepared in a joint effort of 20 public utilities and water districts including the City of Tustin. The City Council approved the Plan on February 5, 2007. The HAZMIT Plan focuses on regional water and wastewater facilities and identifies mitigation actions to reduce the impact of natural and manmade hazards such as fire, flood, earthquakes, landslides, etc. on these critical facilities. The HAZMIT Plan is not binding on any agency, but Water and Wastewater 2012 Update HAZMIT Plan March 6, 2012 Page 2 adoption of the plan by local jurisdictions clears the way far mitigation projects to apply for Federal grants from FEMA. The HAZMIT Plan requires updating every five years. The Municipal Water District of Orange County (MWDOC) acts as the regional facilitator for monitoring and updating the Plan. The Plan has been updated to reflect the most recent information on all water facilities. Two Public Workshops were facilitated by MWDOC to inform, as well as seek input from the public regarding the various components of the Mitigation Plan. The first workshop was held on Tuesday, January 17, 2012, at the Buena Park Civic Center. The second meeting was held on Monday, January 30, 2012, at the offices of the Moulton Niguel Water District in Laguna Beach. MWDOC did not receive any comments or suggestions at the Public Workshops. While the City has na existing water projects which presently require utilization of federal funding opportunities, the completion and approval of the Updated Hazard Mitigation Plan will make the Gity eligible to apply for and receive FEMA disaster mitigation grant funding for water facilities should the need arise and should funding become available. A copy of the updated version of the plan is available on the MWDOC website at and also on file with the City Clerk's Office. Once adopted, the final draft of the Updated Plan will be submitted to FEMA and the California Office of Emergency Services for review and approval. ~~ Co~glas S. Stack, P.E. Director of Public WorkslCity Engineer Attachment: Resolution 12-23 S:\City Council Items\2012 Council Items\Approval of 2012 Updated HAZMIT Plan.docx RESOLUTION NO. 12-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING AND ADOPTING THE UPDATED ORANGE COUNTY REGIONAL WATER AND WASTEWATER MULTI-HAZARD MITIGATION (HAZMIT) PLAN AS IT RELATES TO CITY WATER FACILITIES WHEREAS, Federal legislation has historically provided funding for disaster relief, recovery and some hazard mitigation planning; and WHEREAS, the Federal Disaster Mitigation Act of 2000 (Public Law 106-390; herein the "DMA"}, the latest legislation to improve the hazard mitigation planning process, reinforces the importance of mitigation planning and emphasizes planning for disasters before they occur, allowing, among other things, national post-disaster Hazard Mitigation Grant Program funds to be used far planning activities, and increasing the amount of such funds available to states and communities that have developed a comprehensive, enhanced mitigation plan prior to a disaster; and WHEREAS, the City of Tustin participated with the Municipal Water District of Orange County ("MWDOC") and nineteen other participating water and wastewater utilities in the County of Orange to develop that certain Orange County Regional Water and Wastewater Multi-Hazard Mitigation Plan, dated as February 1, 2012 (herein referred to as the "Plan"}, a copy of which has been provided to the City Clerk at the meeting at which this Resolution has been adopted; and WHEREAS, in order to become eligible for funding and technical assistance for state and federal hazard mitigation programs, the City Council of the City of Tustin is required to formally adopt the plan. follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin as Section 1. The foregoing recitals are true and correct. Section 2. The Updated Plan, in the form as submitted by the City Manager, is hereby approved and adopted, subject to the incorporation of comments, if any, by the State Office of Emergency Services and the Federal Emergency Management Agency upon completion of their review. Section 3. The City Manager (or his designee} is authorized and directed to transmit to MWDOC a certified copy of this Resolution.
