The Planninb Agency of the City of Tustin does hereby
resolve as follows:
1. The Planninb Agency finds and deter::~ines:
a. A proper application (L'se Permit 77-14) has
been. filed on behalf of Edward and Carol Earl
for the operation of a take-out sandwich and
salad shop on a portion of Ste~:art's Tustin
Business Center on ~'+alnut Avenue.
b: That a public hearing was duly called, noticed
. and held on said application.
e. That establishment, maintenance and operation of
the use applied f cr r,~ill not, under the circum-
stances of this case, be detrimental to the
health, safety or general welfare of the per-
sons residing or working in the neighborhood of
such proposed use, evidenced by the following
findings:
1) That said development is in conformance to
.the Tustin Area General Plan.
2) That perimeter landscaping has been pro-
~tided around the exterior of the coraple:~,
_with_inedian planter ..islands in the interior
drive aisles.
3) That said development mill be compatible
with the total master planned complex
within jvhich the development is located.
d. That the establishment, maintenance and opera-
tion of the use applied for ~x:ill not be injuri-
ous nor detrimental to the propert~~ and i~rprove-
ments in the neighborhood of tie subject prop-
erty, nor to the beneral welfare of the City
of Tustin, and should be granted.
e. Proposed development shall be in accordance
with the Zonir_g Ordinance anti the develoi~r_~ent
policies adopted by the City Council, Uniform
~-~ Bui_lding Codes as administered Uy the Fire
Chief , and street ir::provenent requirements as
administered by the City Engineer.
f. That a request for exemption from the Environ-
mental Impact Re~~ort procedures has been filed
and approved.
2. The Planning ~:bency hereby grants a Use Permit, to
authorize a L'se Permit to authorize the operation
of a sand~~ich shop within the Tustin Business

AUTHORIZING TII); OPERATION OF .A SAND4'1ICH SHOP
AT 2640 1'lALNUT AVENUE.
The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines:
a. A proper application (Use Permit 77-14) has
been filed on behalf of Edward and Carol Earl
for the operation of a take-out sandwich and
salad shop on a portion of Stev/art's Tustin

stances of this case, be detrimental to the

6:00 a.m. nor later than 7:00 p.m., P.londays
through Saturdays.
c. The primary business for the operation shall
be directed at those working in and visiting
the Tustin Business Center. Promotion of the
facility for other 'than resident tenants shall

d. The operation shall comply with Sign Ordinance
No. 684 and disi~lay a sign no larger than
five (5) square feet in conformance with a
P,4aster Sign Plan for the Center.
