The Planning Agency of the City of Tustin does
hereby resolve as follows:
1. The Planning Cor•~mission finds and determines as
fol lo~ys
a. That a proper application (_~To. U.P. 77-15)
was filed on behalf of Jerry and Linda Icen-
hower and Parviz and Joann Aria, for a Use
Permit to allow a nursery school for the prop-
- petty located at C00 ti'lest Sixtll Street .
b. That a public hearing was duly called, noticed,
and held on said application.
c. That establishment, raintenance, and operation
of the use applied for will. not , under the
_ circumstances of this case, be detrimental_to
the health, safety, morals, coMfort orr`general
~telfare of the persons residing or working in
the neigh'oorhood of such proposed use, evi-
den~ed by the following findings:
1) Subject property is coned for Public ~.
Institutional use.
2) Develop::~ent requirements for nursery
schools are stipulated for the purpose
of providing -safety for occupants and to
protect the peace and quiet of adjoining
property owners.
d. That the estaUlis;zment, maintenance and opera-
tion of the use applied for will not be injur-
ious or detrimental to the property and
ir,~provei:~ents in the neighborY~ood of tine su~~-
ject property, nor to the general ~veliare of
the City of Tustin , and should be granted .
e. Proposed development shall be in accorcianoe
wit:1 the ~;oning Ordinance and the develol~.:~ent
policies adopted ~~y the City Co~arcil, Uni-
form Building Cones as administered by the
Building Official , Fire Coc:e as adrninisterecl
by the Fire Chief , and street ir:~prover~ent
requireiaents as administered by the City
Engineer.
f . That a rec;uest for exempt ion from the
Environmental Impact Report procedures has
been filed and approved.

a. Building repair acid construction shall comply
- with. the requireri~ents of the Building Official
and the Fire Chie.
b. PerMits shall be required fro;~~ the State Depart-
r~lent of Social tiYelfare as administered Uy
Orange County Dep~~.rtment of ~tielfare.
c. The construction of a solid masonry •,~all on
the freeway pro~~er~tS line and removal of chain
link fenco by perr;~it of tYie Figliway Division
of CalTrans,. with the City paying half of the
cost of the masonry wall.
d. Approval of alternate wood and r~rcught iron
fencing on Sixth Street frontage, subject to

Director.
e . the recording of a reciprocal agreerient for
traffic circulation with adjoininb property
occupied by the Tustin Boys Club.
f . The reciosign of the parking lot to provide a
loading area or, alternatively, the placement
of entrance<<~ays and side~~.alks for Sixth Street
pedestrian access with curb r;,arkings restricted
to a loading zone, with parking and access
design subject to the approval of the City
Engineer and Community Developrlent Director.
PASSED AidD ADOPTED at a special meeting of the

hereby resolve as follows:
1. The Planning Commission finds and determines as
follows:

hower and Parviz and Joann Aria, for a Use
Permit to allow a nursery school for the prop-
perty located at 600 Vlest Sixth Street.

c. That establishment, maintenance, and operation

circumstances of this case, be detrimental to
the health, safety, morals, comfort or general
welfare of the persons residing or working in
the neighborhood of such proposed use, evi-
denced by the following findings:
1) Subject property is zoned for Public w
Institutional use.
2) Development requirements for nursery
schools are stipulated for the purpose
of providing safety for occupants and to
protect the peace and quiet of adjoining
property owners.
d. ^that the establishment, maintenance and opera-
tion of the use applied for will not be injur-
ious or detrimental to the property and
improvements in the neighborhood of the sub-
ject property, nor to the general welfare of
the City of TUstin, and should be granted.
e. Proposed development shall be in accordance
with the honing Ordinance and the development
policies adopted by the City Council, Uni-
form Building Codes as administered by the
uilciing Official, Fire Code as administered
by the Fire Chief, and street improvement
requirements as administered by the City
Engineer.
f. That a request for exemption from the
Environmental_Impact Report procedures has
been filed acid approved.
2. The Planning Agency hereby grants a Use Permit,
as applied for, to allow for the operation of a
nursery school at 600 west Sixth Street, with
signing as proposed, subject to the following
