PARKER, CITY MANAGER FROM: CITY MANAGER'S OFFICE SUBJECT: APPOINTMENT OF OVERSIGHT BOARD MEMBERS BY TUSTIN MAYOR SUMMARY AB 1x26 requires that each Successor Agency to a former redevelopment agency have an Oversight Board. Oversight Board members must be appointed and members shall be reported to the California Department of Finance on or before May 1, 2012 pursuant to the reformation actions taken by the California Supreme Court in its decision upholding the "Dissolution Act." REC®MMENDp-TION It is recommended that by minute action, the City Council concur with the Mayor's appointment of the following individuals to the Oversight Board for the Successor Agency to the Tustin Community Redevelopment Agency: Jerry Amante, representing the city that formed the redevelopment agency and Matt West, representing the employees of the farmer Tustin Community Redevelopment Agency. FISCAL IMPACT Actual appointments of City representatives to the Oversight Board do not have a direct fiscal impact. Although, the City as the Successor Agency of the former Tustin Community Redevelopment Agency is responsible pursuant to Section 34179 of the Health and Safety Cade for paying for "all of the casts of meetings of the Oversight Board and may include such costs in its subsequent administrative budget." Also pursuant to Section 34179, Oversight Board members shall serve without compensation or reimbursement far expenses. BACKGR®UND As discussed in the City Council Agenda Report on RDA Elimination dated January 17, 2012, AB 1x26 requires that an Oversight Board be appointed and a members report be sent to the California State Department of Finance an or before May 1, 2012. The Oversight Board will supervise the activities of the "Successor Agency to the Tustin Agenda Report -Appointment of Oversight Board March 6, 2012 Page 2 Community Redevelopment Agency" and have "fiduciary responsibilities to holders of enforceable obligations and the taxing agencies that benefit from distributions of property tax and other revenues." The Oversight Board will consist of seven members, with five members to be appointed as follows: • Two appointed by the Orange County Board of Supervisors, with one {1) of the members to be a "public" member. • One member appointed by the largest special district, by property tax share, within the territorial jurisdiction of the farmer Tustin Community Redevelopment Agency (the Orange County Flood Control District). • One member appointed by the County Superintendent of Schools to represent schools. • One member appointed by the Chancellor of the California Community Colleges to represent local community colleges in the county. The two remaining members will be under the control of the City. These members are selected as follows: • One member appointed by the Mayor representing the city that formed the redevelopment agency. • One member appointed by the Mayor as a representative of the employees of the farmer agency from the largest employee organization representing former agency employees; in this case, the Tustin Municipal Employee's Association. If positions on the Oversight Board are not filled by May 1st, then the Governor will make the appointments, as he also will if there is a vacancy for more than 60 days on the Board. Since the Oversight Board can begin to operate as soon as a quorum is seated, and there are pending obligations that require review by the Oversight Board, staff would recommend that the Mayor make the appointments. .-~~7 Christine Shingleton Assistant Executive erector
