HOMELAND SOLUTIONS FOR EMERGENCY OPERATIONS TRAINING FOR
CITY STAFF
SUMMARY
Staff is requesting City Council approve a Consultant Services Agreement with Willdan Homeland
Solutions to provide Emergency Operations Center (EOC} training far City staff.
RECOMMENDATION
It is recommended that the City Council approve a consultant services agreement with Willdan
Homeland Solutions in an amount not to exceed $42,593 to provide emergency operations training
for city staff, and authorize the Mayor and City Clerk to execute the Agreement on behalf of the
City.
FISCAL. IMPACT
Sufficient funds for this training has been budgeted and appropriated in the Fiscal Year 2011-2012
Public Works Department Operating Budget.
DISCUSSION
In 2011, staff and WiNdan Homeland Solutions completed a new Emergency Operations (EOP)
plan far the City that is fully compliant with all State and Federal requirements. Routine training is
necessary to insure that staff is prepared to activate the EOC in the event of a significant incident
or major disaster and sustain City and a regional operation until the incident is resolved. Staff is
proposing to utilize the services of Willdan to conduct the first major training exercise utilizing the
new EOP.
The scope of work includes two important training opportunities for key staff from City departments
that may be required to report to the Citys Emergency Operation Center during a disaster:
A 20 hour EOC Section Specific Training Course which will be tailored specifically to
the Citys approved EOP; and
A 4 hour tabletop and limited functional emergency exercise in the EOC which will
incorporate external agency response and coordination while utilizing established
command, control, and communications systems and an external Incident Command
Post (ICP).

In addition to completing the tasks above, Willdan will prepare an after action report which will
include a review of the City's performance during the exercise and will provide recommendations to
improve City emergency response capabilities. Where applicable, the findings in the after action
report and individual staff assessments will be incorporated into the City's EOP. Staff anticipates
that the training will be completed by the end of June 2012.

CONSULTANT SERVICES AGREEMENT
THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into
this _ day of 20 by and between the CITY OF TUSTIN, a municipal
corporation, hereafter referred to as "City", and Willdan Homeland Solutions, a California
Corporation, hereinafter referred to as "Consultant".
RECITALS
WHEREAS, City requires the services of a consultant to furnish the necessary
design and implementation services for the delivery of a City of Tustin tailored section
specific emergency operations training course and a NIMS EOC tabletop drill with partial
Functional Exercise (FE) design including development of an After Action Report (AAR)
hereinafter referred to as "Project"; and
WHEREAS, Consultant has submitted to City a proposal dated January 18, 2012,
a copy of which is attached hereto marked as Exhibit "A" and is by this reference
incorporated into this Agreement; and
WHEREAS, Consultant is qualified to provide the necessary services for the
Project and desires to provide said services to City; and
WHEREAS, City desires to retain the services of Consultant for said Project.
NOW, THEREFORE, for the consideration and upon the terms and conditions
hereinafter set forth, the parties agree as follows:
AGREEMENT
Section 1: Scope of Consultant's Services
Consultant shall perform all work necessary to complete in a manner satisfactory
to City, the services set forth in Exhibit "A" in accordance with the terms and conditions of
this Agreement.
Section 2: Order of Precedence
In the event of a conflict between or among any of the documents comprising this
Agreement, the following order of precedence shall govern the provision in question:
1. This Agreement
2. Consultant's Proposal (Exhibit "A"}
Section 3: Time for Completion
The time for completion of the work to be performed by Consultant is an essential
condition of this Agreement. Consultant shall prosecute regularly and diligently the work
of this Agreement according to reasonable schedules established by the City for various
items described and as outlined within Consultant's proposal. Consultant shall not be
accountable for delays in the progress of its work caused by any condition beyond its
control and without the fault or negligence of Consultant.
Section 4: Compensation
A. The compensation to be paid under this Agreement shall be as set forth in Exhibit
"B", which shall not exceed a total cost of X42,593.00.
B. Consultant shall submit detailed invoices, based upon the actual work performed
accompanied by backup documentation as requested by the City.
C. Progress payments for work completed shall be paid by City as the work
progresses, within thirty (30) days of the date of Consultant's invoice.
D. Consultant shall provide City with a monthly itemization of all work performed, and
the fees accrued thereon, in complete and sufficient detail to fully apprise City
thereof.
Section 5: Independent Contractor
Consultant's relationship to City in the performance of this Agreement is that of an
independent contractor. Consultant's personnel performing services under this
Agreement shall at all times be under Consultant's exclusive direction and control and
shall be employees of Consultant and not employees of City. Consultant shall pay all
wages, salaries and other amounts due its employees in connection with this Agreement
and shall be responsible for all reports and obligations respecting them, such as social
security, income tax withholding, unemployment compensation, worker's compensation
and similar matters.

Section 6: Indemnification
Consultant agrees to indemnify, defend and hold City, its officers, agents,
employees, successors and assigns harmless from any loss, damage, injury, sickness,
death, or other claim made by any person and from all costs, expenses and charges
including attorney's fees caused by or arising out of Consultant's, its officers', agents',
subcontractors', or employees' negligent acts, negligent errors, or negligent omissions or
willful misconduct, or conduct for which the law imposes strict liability on Consultant in the
performance or failure to perform this Agreement.
Section 7: Insurance
A. Consultant shall maintain in full force and effect during the term of this Agreement
policies of commercial general liability and automobile liability insurance (each of
which shall include property damage and bodily injury) and each with limits of at
least $1,000,000 combined single limit coverage per occurrence.
B. Consultant shall carry and pay far such workers' compensation insurance as is
required to fully protect Consultant and its employees under California Worker's
Compensation Insurance Law. The insurance company shall agree to waive all
rights of subrogation against the City far losses paid under the policy, which losses
arose from the work performed by the named insured.
C. Other applicable insurance requirements are: (1) Name the City, its officials and
employees as additional insured on the commercial general liability and
automobile liability insurance policies. {2) The insurance shall be issued by a
company authorized by the Insurance Department of the State of California and
rated A, VII {seven) or better (if an admitted carrier) or A-, X (ten) or better (if
offered by a surplus line broker), by the latest edition of Best's Key Rating Guide,
except that the City will accept workers' compensation insurance rated B-, VII
(seven) or better, or from the State Compensation fund. (3) The insurance shall
not be cancelled, except after thirty (30) days written prior notice to the City; and
(4) The commercial general liability and automobile liability insurance shall each
be primary as respects the City, and any other insurance maintained by the City
shall be in excess of this insurance and not contribute to it.
D. Upon execution of this Agreement, Consultant shall provide to City certificates of
insurance and insurer endorsements evidencing the required insurance. Insurer
endorsements (or a copy of the policy binder if applicable) shall be provided as
evidence of meeting the requirements of Subsections (1)(3) and (4) of Section 7D
above and the waiver of subrogation requirement in Section 7C above. If self-
insured far worker's compensation, Consultant shall submit to City a copy of its
certification of self-insurance issued by the Department of Industrial Relations.

Section 8: Termination of Agreement
A. City and Consultant shall each have the right to terminate any or all of the services
covered by this Agreement at any time or any reason by giving ten (10) business
days written advance notice to the other party.
B. Upon termination of this Agreement, Consultant shall be paid for services
rendered by the effective date of the termination.
C. Upon termination of this Agreement or completion of the Project, all documents
relating to the Project shall become the sole property of City. Should City
terminate this Agreement pursuant to subparagraph A. of this Section, Consultant
shall within ten (10) business days of receipt of notice of termination, provide City
with all documents within Consultant's possession relating to this Agreement and
the Project, including but not limited to all completed documents and all drafts of
uncompleted documents.
Section 9: Notice
Any notice allowed or required to be given shall be effective upon personal
delivery thereof, or upon depositing thereof in the United States Postal Service, certified
mail, upon receipt requested, postage prepaid, addressed as follows:

Section '10: Miscellaneous Provisions
A. Consultant shall proceed immediately and diligently to perform the services
provided for in this Agreement upon receipt of notice from City to proceed
therewith.
B. No part of this Agreement may be assigned by Consultant without the prior written
approval of City.

C. This Agreement shall extend to and be binding upon and inure to the benefit of
heirs, executors, administrators, successors and assigns of the respective parties
hereto.
D. Consultant shall perform all services required under this Agreement using that
degree of care and skill ordinarily exercised under similar conditions in similar
localities, and shall be responsible for all errors and omissions for services
performed by Consultant under the terms of this Agreement.
E. Consultant certifies that there shall be no discrimination against any employee
who is employed in the work covered by this Agreement, or against any
application of such employment, because of race, religion, color, sex, or national
origin including but not limited to, the following: employment, upgrading, demotion
or transfer, recruitment, or recruitment advertising, lay-off or termination, rate of
pay or other forms of compensation, and selection for training, including
apprenticeship.
F. This Agreement shall be interpreted in accordance with California Law. The
parties agree that the Orange County Superior Court is the exclusive venue for
any lawsuits by either party regarding this Agreement.

Dear Mr. Meyers:
Willdan Homeland Solutions {Willdan} is a full service homeland security professional services firm that
has been providing planning, training, and exercise support to emergency management and public safety
agencies since 2004. Our staff has worked in and with the City of Tustin {City} and adjacent cities for
years. Mast recently, we provided the City of Tustin with an approved Emergency Operations Center
{EOP) plan. We offer the City a seasoned team of local emergency management professionals who are
skilled in the design and delivery of Section Specific EOC training; as well as in the design and delivery of
Homeland Security Exercise and Evaluation Program {HSEEP} -compliant functional exercises {FE}.
Team members supporting this project will work from Willdan's offices in Anaheim, CA which will ensure
their availability for ad hoc meetings with City personnel. The following paragraphs highlight the
advantages Willdan brings to the City of Tustin in providing the requested services and how those
services represent the best value to the City.
Our team is ied by Mr. Ron Burgess who wilt serve as our project manager and is responsible for
the project's development and final execution. Ron will lead a team staffed with HSEEP-certified
exercise support personnel and subject matter experts who have served in key leadership roles in
numerous major incident and disaster response. Willdan support staff will provide Ron with analytical,
graphics, videography, and GIS/mapping support to create professional deliverables. Fielding an
experienced team with established relationships with the City is key to meeting the City's training needs.
All of our training and exercise design efforts will be geared toward producing a realistic training
environment that provides challenging, hands on opportunities to utilize the City's Emergency Operation
Center's command, control, and communications systems and incorporate multiple outside agencies
working in both the EOC and Incident Command Post {ICP}. Our staff will coordinate and facilitate a
planning meeting to develop tabletop exercises {TTX} far the Section Specific EOC Course. Willdan will
administer its DHS/CA POST approved Section Specific Course, with tailored to Tustin TTXs, at dates to
be determined. Our staff will also coordinate and facilitate formal planning meetings in accordance with
accepted HSEEP directives. The information gathered at these meetings will serve as the basis for
developing the exercise and evaluation plans to accomplish the City's exercise objectives {awareness,
application, evaluation). Complementing these plans will be simulation tools that will enhance exercise
realism. These tools include simulated newscasts, SIMCELt_ operations, Master Scenario Events List
{MSEt_), pre-scripted WebEOC entries, mapping and other GIS products as required.
When combined, these plans and tools will yield an excellent evaluation of the EOC's capability elements
and produce a meaningful after-action report {AAR) with actionable recommendations.

A critical part of the emergency management process involves preparing to operate an Emergency
Operations Center (EOC). Awell-designed EOC can greatly benefit the coordination of response and
recovery activities. Defining clear operating procedures, staff roles, and responsibilities is essential to
creating an effective workspace and a safe location.
It is certain that good planning and preparedness today will improve emergency response and expedite
the recovery process. Having good plans in place, drilling on them, and using an organized information
management system to implement and track their execution will prove invaluable, no matter what the
problem.
The City of Tustin has indicated a need for Wiildan's 20 hour-DNS/CA POST approved Section Specific
Emergency Operations Course, This course will be tailored to the Gity of Tustin's current EOP with
tabletop exercises. As well as the need fora 4-hour EOC tabletop drill with partial functional exercise
design services. Both of these will be designed to enhance the City's capability to develop and execute
various routine and emergency plans according to contemporary and Department of Homeland Security
standards. Specifically, the City is in need of consultant services from qualified consultants with
experience in utilizing SEMSINIMS principles as a supervising first responder in the law enforcement,
fire fighting, or public works professions. Our proposed Project Manager, Mr. Ron Burgess
possesses over 34 years of law enforcement and emergency preparedness experience. Mr.
Burgess is highly qualified in all areas of emergency management planning, training and
exercise.
Willdan has assembled a team of professionals second to none. Ali of the team members have
thousands of combined hours actually working as emergency managers andlor as first
responders (including lncidenf Commanders) to emergency events, some of which have
occurred in Tustin and neighboring cities. Over the years, these team members have helped

Mr. Ron Burgess has over 34 years in law enforcement. He has experience in operations,
organizational management, strategic planning and public safety operations. He has been involved in
organizational strategy development, policy development, personnel management and has an extensive
teaching background with two California teaching credentials. Within his law enforcement career, he has
logged over 20 years of tactical experience as a SWAT Officer, Team Leader and Commander. Mr.
Burgess commanded the Huntington Beach Detective Bureau and in addition has logged over 5,500
flight hours as a Helicopter PilotlFlight Instructor. He is well-versed in HSEEP compliant exercises
having designed, developed, conducted and evaluated discussion and operations-based exercises far
many state and local jurisdictions.

Mr. Victor Thies has bean involved in law enforcement and emergency preparedness for 35 years. This
includes 21 years as a police manager, retiring as a Commander for the City of Irvine Police
Department. Over these 35 years, he has gained experience as a trainer, training program
designertdeveloper, and management specialist. He is nationally known for his expertise in dealing with
management issues involving critical incident management, unified command, EOC operations, and
critical incident response. Mr. Thies is an expert on the Standardized Emergency Management
Systemtlncident Command System (SEMSIICS}and served on California State committees for training
development in disaster response. Mr. Thies brings valuable assets to the Willdan team with his years of
public safetylemergency response experience and training, management, tactical and supervisory
issues. He was a key member in the Implementation Team for the creation of the Irvine Police
Department and has published numerous articles on law enforcement and disaster response.

Section-Specific Emeraencv Ooeratipns Center Training Course
This 20-hour course will be tailored to the City of Tustin's Emergency Operations Plan and addresses
the responsibilities of emergency response and support from the "Tustin" perspective -not from a
generic template approach.
Day One of the course is training for the Operations and Planning Sections. Day Two brings together
the Logistics and Finance Sections staff while Day Three is training for the Management Staff and
Section Coordinators. Each day incorporates exercises tailored to the City of Tustin's Emergency
Operations Plan. This course will prepare participants for a successful EOC Functional Exercise.
Recipients of this course will understand their ro/eslresppnsibttities within fhe EOC and will
function of a higher level of proficiency, which will afford the Ctfy of Tustin staff more
opportunity to evaluate plans, equipment, and the EOC organization.
NIMS Emeraencv Operations Center (EOC) Tabletop Drill with Partial Functional
Exercise Design
Willdan will provide a team skilled in exercise design and delivery to assist the City of Tustin, with
the facilitation and development of a 4-hour tabletop drill with partial functional exercise design
focused on the City's response to a major incident scenario. In addition to creating the stimuli
necessary to simulate EOC support to field operations, the scenario, MSEL and design elements will
be structured to support EOC activation procedures, Incident Command Post interaction, obtaining
lagisticat and response support from outside Tustin, working in a unified command with multiple
response agencies, and activation of a mass causality plan.
The paragraphs below provide an overview of our approach to deliver the FE.
Exercise Design and Development
Willdan will facilitate all aspects of the exercise design and development. We will seek only guidance
and direction from the exercise design team and our staff will do the "heavy lifting" associated with
developing the core exercise design deliverables which include the exercise plan (ExPlan), controller
and evaluation manual (C!E Manual), MSEL, phone directories, fast facts, exercise badges, and
registration materials. Moreover, our administrative team wilt provide the coordination and materials
necessary for all planning meetings, which will include meeting invites, meeting reminders, handouts,
registration materials, and meeting minutes. They will ensure planning meetings are scheduled to
maximize design team availability.
The research and development of a realistic exercise scenario wiN be the most important task in the
exercise design and development phase. Functional exercises are by far the most challenging exercise
type to create because of the requirement to "simulate everything" outside the EOC doors. Therefore,
the scenario and MSEL that drive and stimulate the exercise participants into action are extremely
important and the lion share of the work we do will be to analyze and build upon the past training
tabletop exercises Willdan provided to the City of Tustin. Having this prior knowledge of likely scenarios
to impact the Gity, our staff analysis wilt include identification of the agencies! organizations involved in
the scenario response and their roles/responsibilities so that we can accurately simulate their
involvement from the simulations cell (SIMCELL}. Simulation of these agencies could include internal
{Tustin} andlor outside organizations such as Orange Gounty Fire Authority, volunteer organizations,
special districts, and FEMA. Our analysts and subject matter experts will strive to replicate the
environment within which City of Tustin EOC responders wil! operate during a real world event.
In addition to the realism created by the scenario design, Willdan will also develop exercise tools to
enhance the realism of the exercise. Willdan has an in house videography unit that creates video
projects that support and enhance our exercises. We envision our videography unit wttl work with
our scenario developers to create one or more simulated newscasts, which will be delivered
during fhe exercise day, In addition to the newscasts, Willdan will also create mapping and other GIS

scenario developers.
Target Capabilities
Willdan Suggests the incorporation of the National Planning Scenarios and establishment of the
National Preparedness Priorities, which have steered the focus of homeland security toward a
capabilities-based planning approach. Capabilities-based planning focuses on planning under
uncertainty because the next danger or disaster can never be forecast with complete accuracy.
Therefore, capabilities-based planning takes an all-hazards approach to planning and preparation that
builds capabilities that can be applied to a wide variety of incidents. States and urban areas use
capabilities-based planning to identify a baseline assessment of their homeland security efforts by
comparing their current capabilities against the Target Capabili#ies List (TCL) and the critical tasks of the
Universal Task List (UTL). This approach identifies gaps in current capabilities and focuses efforts on
identifying and developing priority capabilities and tasks for the City of Tustin.
The capabilities listed here have been suggested for the City of Tustin's Emergency Operations Center
Exercise. These capabilities provide the foundation for development of the exercise objectives and
scenario. The purpose of this exercise is to measure and validate performance of these capabilities and
their associated critical tasks. The selected capabilities are:

• Citizen Evacuation and Shelter-In-Place

Exercise Objectives
Willdan will work wi#h the Gity's Exercise Planning Team (EPT) to select and finalize objectives that
focus on evaluating emergency response procedures, identifying areas for improvement, and achieving
a collaborative attitude. We suggest the following objectives as a starting point for the EPT:
1. Emergency Operations Center Management. Evaluate the EOC's ability to provide multi-
agency coordination for response management through the activation and operation of the
EOC, coordinating EOC action planning, and managing emergency information and
communications; consistent with Tustin's Emergency Operations Plan {EOP).
2. Emergency Public Information and Warning. Demonstrate the abilities of the City's Public
Information staff to develop, monitor, disseminate, and manage a continuous flow of accurate,
consistent, and timely information to multi jurisdictional law enforcement personnel, EMS and
emergency responders, public health partners, and the public throughout the duration of a
large event.
3. Mass Casualty. Evaluate the EOC's ability to generate priorities for immediate on-scene
triage, transport and medical care for injuries.
4. Citizen Evacuation and Shelter-In-Place. Evaluate the EOC's capability to coordinate and
accurately provide timely citizen evacuation, and shelter-in-place guidance to affected
stakeholders during an emergency response.
5. Mass Care -Sheltering, Feeding and Related Services. Assess the EOC's rapid activation
and mobilization of shelters for mass care services, as well as its cooperation and
coordination with local sheltering efforts for those disabled and non-disabled persons living
within the affected area.
6. Critical Resource logistics and Distribution. Assess the EOC's ability to identify, mobilize,
recover, and accurately track & record available human and material resources as relates to
establishing and maintaining shelter operations as a result of explosions.

Exercise Co»duct a»of Evaluation
ControllerlEvaluatorond SIMCELL training sessions will be provided. Roles, responsibilities, and the
exercise control/evaluation plans will be reviewed in addition to providing each Control staff member
with the tools (ExPlan, C!E Manual, Fast Facts, etc.) they need to effectively control/evaluate the
exercise.
During the exercise, Willdan controllers will serve in key positions. Ron Burgess will serve as the Senior
Controller during the exercise with support from our subject matter experts who will be strategically
placed in key EOC locations to ensure exercise participants are adequately supported. Given the
importance of the SIMCELL, Willdan will staff the SIMCELL officer-in-charge positions. With controllers
in key positions overseeing the delivery of the exercise and monitoring the evaluator's progress, a
smooth FE delivery and evaluation will be guaranteed.

Willdan is the prime contractor supporting the AnaheimJSanta Ana Urban Area Security Initiative
(ASAUA) 5-Year Training and Exercise Program. In preparation far the Urban Area's participation in
Golden Guardian 2008 FE, The Great California Shake Out Willdan provided a series of general
and section specific emergency operations center (EOC} training courses that prepared EOC
personnel for their participation in the exercise. EOC personnel from 34 cities participated in 8 EOC
training deliveries conducted over a 2-month period. Moreover, Willdan has delivered over 30 ICS
100 - 400 direct delivery and train-the-trainer courses to audiences across Orange County. In support
of the Urban Area's participation in the Golden Guardian 2008 Functional Exercise, Willdan provided
exercise design, development, conduct, and evaluation support services to over 24 participating cities
and 14 agencies. Since 2005, Willdan personnel have designed, developed and delivered over 25
discussion and operations-based HSEEP compliant exercises.

Willdan was selected via competitive solicitation in January of 2009 to provide exercise design and
development support far a countywide pandemic flu full-scale exercise. Exercise design began in
February, 2009 but was halted in April due to the H1 N1 outbreak. Following the H1 N1 outbreak,
SCCDPH modified the Willdan contract to add a countywide earthquake functional exercise (FE) which
included participation from 10 hospitals, 7 Skilled Nursing FacilitiestLong-Term Care, RACES
Operators, Community Health Partnership, Operational Area EOC, and the SCCDPH Department
Operations Center. Exercise design of the functional exercise began in August, 2009 and was
completed in December, 2009 with the delivery of the final AAR.

Willdan was the prime contractor for the City of Los Angeles Emergency Management Department's
(LA EMD} EOC Standard Operating Procedure development and Section Specific Training with Train-
the-Trainer delivery project. This project, led by Biil Wolf, included the development of an EOC SOP
with position specific checklists, asection-specific EOC training course tailored to the EOC SOP,
and asection-specific EOC train-the-trainer course. Bill and his support team worked closely with LA
EMD personnel and other stakeholders to develop an EOC SOP for the City's new, state-of--the-art
EOC. The manual, developed from scratch, included the "how to" of the following topics: EOC
organization, Situation Analysis, Information FlowtCommon Operational Picture, EOC Action Planning,
Resource Management, Mutual Aid, and Public Information. Following the development of the SOP,
BiH and his support team developed a tailored, three-day section specific training course that provided
EOC personnel with position specific training on the EOC operations detailed in the SOP. The final
project deliverable included atrain-the-trainer module to enable LA EMD staff to continue the training
program into the future.

Willdan was selected through competitive solicitation to lead the Emergency Management Mutual Aid
and Assistance (EMMAA} Training and Advanced Tabletop development project. The purpose of the
course is to provide 100 emergency managers drawn from throughout California with the training they
need to participate in Emergency Management Support Teams {EMST). EMST's will be capable of
deploying on short notice to assist impacted jurisdictions during catastrophic incidents by filling key
positions within their EOC's. The 5-day course, developed by Bill Wolf and Willdan support staff,
includes instruction on EOC management, Situation Analysis, Leadership, Public Information,
Resource Management, Information Management (UVebEOG, ETeam, and RIMS), and EOC Action
Planning. The advance tabletop exercise will provide students with an opportunity to apply their
EMMAA training during hands on activities that include: Situation Analysis, EOG Action Planning, and
Public Information Operations. Willdan also developed atrain-the-trainer course to enable the State of
California to continue the EMMAA training program into the future. Graduates of the class will be able
to work in EOC's at any level from Local to the State Operations Center.

The California POST approved price for the 20-hour course, which includes development fees for
tailoring the course is $20,750. As there will be limited travel and per diem and with the City providing
seminar facilities, Willdan wilt reduce the course cost by 15% to $ 17,600.
