RESOLUTION NO. 1636
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN AUTHORIZING THE REMODELING OF THE
JACK-IN-THE-BOX RESTAURANT FACILITIES AT 14002
NEWPORT AVENUE (USE PERMIT 77-12)

The Planning .Commission does hereby resolve as follows'
1. The Planning Commission finds and determines'
A. That a proper application was filed by Foodmaker,
Inc., to request authorization to construct a
building addition and an outdoor dining facility
for the Jack-in-the-Box restaurant located at
14002 Newport Avenue.
B. That a public hearing was duly called, noticed
and held on said application.
C. That establiDhn~ent, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental to the
health, safety, morals, comfort or gener~wel-
fare of the persons residing or working in the
neighborhood of such proposed use, evidenced by
the following findings:
1) That the subject use is in conformance with
the Tustin Area General Plan as adopted by
the City Council of Tustin, and
9.) That the development was approved by Use
Permit 67-244 and has been operating in con-
formance with the provisions of said permit
since its construction.
D. That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.
E. Proposed development shall be in accordance with
the Zoning Ordinance and the development policies
adopted by the City Council, 'Uniform Building
.Codes. as administered by the Building Official,
Fire Code as administered by the Fire Chief, and
street improvement requirements as administered
by the City Engineer.
F. That said project is categorically exempt from
the Environmental Impact Report requirements
per-City guidelines and procedures.
The Planning Commission hereby grants a Use Permit
as applied for, to allow the addition of an enclosed
building area and of an outdoor dining facility as
indicated within the application subject to the
following conditions:

a. That fina'l development plans be submitted for
~' for review to include, plot, landscaping, irri-
gation, and sign plans.
b. That the building will be limited to three wall
~igns of 25 square feet each, to be mounted on
the front and side wall areas. ..
c.. That the seating capacity of the restaurant
dining areas shall not exceed 66.
PASSED AND ADOPTED at a regular meeting of the City of
Tustin Planning Commission, held on the 13th day of June, 1977.
