RESOLUTION NO. 1635
A RESOLUTIO OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN AUTHORIZING THE REMODELIG OF THE
JACK-IN-THE-BOX RESTAURANT FACILITIES AT 17401
17TH STREET (USE PERMIT 77-11).

JACK-IN-TI{E-BOX RESTAURA~T FACILITIES AT 17401
17TII STREET (USE PEFD, IIT'77-11).
The Planning Commission does hereby resolve as follows'
1. The Planning Commission finds and determines:
A. That a proper application was filed by Foodmaker,
Inc., to request authorization to construct a
building addition and an outdoor dining facility
for the Jack-in-the-Box restaurant located at
17401 17th Street.
B. That a public hearing was duly called, noticed,
and held on said application.
C. That establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental to~the health,
safety, morals, comfort or general welfare of
the persons residing or working in the neighbor-
'~ hood of such proposed use, evidenced by the fol-
lowing findings:
1) That the subject use is in qonformance with
the Tustin Area General Plan as adopted by
the City Council of Tustin, and
2) That the development was approved by Use
Permit 69-285 and has been operating in con-
formance with the provisions of said permit
since its construction.
D. That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.
E. Proposed development shall be in accordance with
the Zoning Ordinance and the development policies
adopt, ed by the City Council, Uniform Building
Codes as administered by the Building Official,
Fire Code as administered by the Fire Ct]ief, and
street in]provement requirements as administered
by the City Engineer.
F. That said project is categorically exempt from
the Environmental Impact Report requirements
per City guidelines and procedures.
2. The Planning Commission hereby grants a Use Permit
as applied for, to allow the addition of an enclosed
building area and of an'outdoor dining facility as
indicated within the application, subject to the
following conditions:

That final development plans be submitted for
for review to include plot, landscaping, and
irrigation 'plans.
b. That additional landscaping shall be provided
by means of an enlarged planter along the 17th
Street frontage and by addition of specimen
trees.
c. That the signing non-conforming will be reduced
by the removal of the figure from atop the
existing pole sign.
d. That the seating capacity of the interior and
exterior dining area shall not exceed 6~.
