U.P. 77-10 OF HON DEVELOPMENT COMPANY FOR A SKATE PALACE. SSION OF TIIE CITY OF TUSTIN GilANTING A CONDITIONAL USE PEFg,IIT ON APPLICATION NO. U.P. 77-19, OF I:Q:,; DEVELOPMENT CO?.IPAI.~Y FOR A SI[ATE PALACE. The Planning Co~.nission of the City of Tustin does hereby resolve as follows- 1. The Planning Comr.]ission of the City of Tustin £inds and determines as follows' A. That a proper application (No. U.P. 77-10) was was filed by Hon Development Company, 25200 La Paz, Laguna ttills, CA 92653, for a conditional 'Use Permit to allow the constructio and operation of a'rollerskating rink for the property located on the property bounded by the Newport Freeway, on-ramp, McFadden Avenue, and Tustin Village ~ay. B. That a public hearing was duly called, noticed and held on said application. '~ C. That establishment, maintenance and operation of the use applied for will not, under the circum- stances of this case, be detrimental to the health, safety, morals, comfort or general wel- fare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: l) The proposed use is in conformance with the Land Use Element of the Tustin Area General Plan and the Conumercial zoning of the parcel. · 2) Subject use is remote from residential dwell- in~s. D. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the Zoning Ordinance and the development poli- cies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. F. That the proposal has been addressed by Environ- mental Impact Report No. 77-2, as approved by the Planning Con~nission. · 9.. The submission and al)proval by staff o£ a revised plot plan to mitii~ate adverse traffic circ.'.ul;~tion problems, with drive-cuts to conform with City standards, and dedications to the satisfaction .o~ the City Engineer. B. Parking spaces may be reduced to resolve circul~ patterns without decreasing buildinq area. C. Accom~nodation of handicapped parking requirements. D. The installation of an on-site fire hydrant capable of providing 1500 g.p.m, at 20 p.s.i. and tt~e installation of a fire sprinkler system to the satisfaction o£ the Fire Chief. E. 'Approval of signing in accordance with the sign plan-on file dated May 8, 1977, authorizing one sign on each wall, with no sign to exceed 75 square feet maximum area, with further authority for a freestanding complex identification sign in accordance with the' ~ign Code standards. F. Satisfaction of the terms and conditions of Parcel Ilap 77-96. G. Compliance with mitigation measures proposed by EIR 77-2 to include but not limited to' 1) Providing on-site security patrol during ope~- ating hours, to the satisfaction of the Chie. of Police, and at no public expense. 2) The replacement of freeway fencing with a 6'8" masonry wall to the satisfaction of the Division of }lighways of CALTRANS and the Community Development Director ATTEST' PLANNING, C,O,~l: I I 5 ~ 10N RECOEDI NG SECRETARY 3) The submittal and approval of landscape plans to the satisfaction of the Community Development Director. H. The submittal of precise development plans to the Community Development Department to include light- ~' ing, colors and materials lng, landscaping, si,,n , and elevations, with the further proviso that all roof-top equipment shall be screened from public view. I. Change in use will require a new Use Permit.
