RESOLUTION NO. 1032
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN GRANTING A CONDITIONAL USE PER-
MIT ON APPLICATION NO. U.P. 77-9 OF TACO DE
CARLOS.
The Planning Commission of the City of Tustin does
hereby resolve as follows'
1' The Planning Commission finds and determines as
follows' ~
A. That a proper application (No. U.P. 77-9) was
filed on behalf of Taco de Carlos by Hon Devel-
opment Company, 25200 La Paz, Laguna Itills, .CA
92653, for a conditional use permit to allow
the construction and operation of a fast food
drive-thru restaurant for the property 'located
at the southwesterly portion of the lot bounded
by McFadden, Newport Freeway, freeway on-ramp,
and Tustin Village ~Vay. ~ '
B. That a public hearing was duly called, noticed
and held on said application.

C. That establishment, maintenance and operation
:of the use applied for will not, under the cir-
cumstances of this case, be detrimental to the
he~.Ith, safety, morals, comfort or general wel-
fare of the persons residing or working in the
neighborhood of such proPosed use, evidenced
by the following findings:

1) The proposed use is in conformance with the
Land Use Element of the~Tustin Area General
Plan and the Commercial zoning of the parcel.
Subject use is remote from residential
dwellings.

D. That the establishment, maintenance and opera-
tion of the use applied for will not be injuri-
ous or detrimental to the property and improve-
".ments in the neighborhood of the subject prop-
erty,.' nor to the general welfare of the City of
Tustin, and should be granted.
E. Proposed development shall be in accordance
with the Zoning Ordinance and the development
policies adopted by the City Council, Uniform
Building Codes as administered by the Building
Official, Fire Code as administered by the Fire
Chief, and street improvement requirements as
administered by the .City Engineer.
F. That the proposal has been addressed by
Environmental Impact Report No. 77-2 as adopted
by the Planning Commission.
2. The Planning Commission hereby grants a Use Permit,

'operation of a fast food drive-thru restaurant,
s~lbject to the following conditions'
A. The submission and approval by staff of a
revised'plot plan to mitigate adverse traffic
circulation problems, with drive-cuts to con-
form with City standards, and dedications to
the satisfaction of the City Engineer.
B. 5!odification of the plot plan to meet City of
Tustin parking lot standards,, with couble s
lanes authorized for drive-thru facilities.
C. Accommodation of handicapped parking require-
ments.
D. Signing shall conform to the Tustin Sign Code
to consist of one (1) 75-square-foot primary
identification sign, and three (3) 25-square-
foot wall signs.
E. Compliance with recommended mitigation measures
as specified in EIR 77-2.
