U.P. 77-8 OF WENDY'S. The Planning COm~nission of the City of Tustin does hereby ordain as follows' 1. The Planning Commission finds and determines as follows' , A. That a proper application (No. U.P. 77-8) was filed on behalf of Wendy's by Carlson Design and Construction Co., P.O. Box 819, Anaheim, CA - 92805, for a conditional use permit t'o. allow the construction and operation of a drive-thru fast food restaurant known as ¥;endy's for the property located at the north- westerly portion of the southeasterly corner of Tustin Village Way and the Newport~-F_re~way Freeway on-ramp. B. That a public hearing was duly called, noticed and held on said application. C. That establ.ishment, maintenance and operation of the use applied for'will not, under the cir- cumstances of this case, be detrimental to the health, safety,, morals', comfort or general wel- fare of the pehsons residing or working in the neighborhood of such proposed use, evidenced by the following findings' l) The proposed use is in conformance with the Land Use Element of the Tustin Area General Plan and the Comn]ercial Zoning , of the parcel. 2) Subject use is remote from residential dwellings. D. That the establishment, maintenance and opera- tion of the use applied for will not be injuri- ous or' detrimental to the property and improve- ments in the neighborhood of the subject prop- erty, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the Zoning Ordinance and the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement require- ments as administered by. the City Engineer. The Planning Commission hereby grants a Use Permit ~s applied for, to allow the construction and oper- ation ok a fast food drive-thru restaurant, subject to the following conditions: A.. The submission and approval by staff of a revised plot plan to mitigate adverse traffic circulati~ problems, with drive-cuts to conform with City standards, and dedications to the satisfaction of the City Engineer. B. ~lodification of the plot plan to meet City of Tustin parking lot standards. C. Accommodation of handicapped parking require- ments. D. Signing shall conform to the Tustin Sign Code to 'consist of one (1) 75-square-foot primary identification sign, and three (3) 25-square- foot wall signs. E. Perimeter fencing and/or landscape de~s. ign.to the satisfaction of CALTRANS, Divisio. f ~)f High- ways, and the City Community Development Depart- ment. PASSED AND ADOPTED at a regular meeting of the City of Tustin Planning Commission, held on the 13th day of June, 1977.
