HomeMy WebLinkAboutPC RES 1629 4 6 ? 9 .10 11 14 17 18 19 Z0 24 Z6 Z9 RESOLUTION NO. 1629 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN RECOMMENDING APPROVAL OF ZONE CHANGE 77-5 (PLAZA WAY ) The Planning. Commission of the City of Tustin does hereby resolve as follows: 1. The Pianning Commission finds and determines as follows: a. That a proper application (No. ZC 77-5) has been filed by Investors Development of Orange County, Inc. for a Zone Change from the Planned Community (Business) District to the Planned Community (Residential) District for properties known as Lots 5, 6, 7, 8, 9, and 10 of Tract No. 8475, bounded by Irvine Boulevard and Holt Avenue. b. That a public hearing was duly called, noticed and held on said application. c. That a zone change should be granted for the fol- lowing reasons: 1) Said proposal conforms with the Tustin A~ea General Plan, as amended. ~ 2) A density of 56 dwelling units at 17 units per acre is consistent and compatible with other developments within the area. d. A Negative Environmental Impact Report was re- quested and is hereby approved based upon an initial s. tudy. 2. The Planning Commission hereby, recommends to the City Council the approval of Zone Change Application No. 77-5, subject to the following terms and conditions: a. Plot plans and elevations shall be approved by the Planning Commission prior to the issuance of building permits. b. Development of subject property shall be in ac- cordance with the policies and ordinances as adopted by the City Council to include the Uniform Building Code, Fire Code, Public Works Improvement Standards, Development Standards and criteria of the Zoning Ordinance. c. Park 'land fees shall be required in lieu of park land dedication in accordance with Ordinance No. 685. d. Parcel Map applications and reciprocal easements shall be required conditions of approval for developments using common property access. e. Satisfaction of the requirements for permits and agreements of other agencies having title or jurisdiction over subject property, to include the Flood Control District and the Southern California Edison Company. 1 4 § 6 ? 8 9 10 11 12' 14 15 16 17 18 19 20 24 25 26 27 28 29 51 Resolution No. 1629 5-23-77, Page 2 f. The undergrounding of all utilities within the subdivision. g.. The satisfaction of terms and conditions of the Tustin Plaza Precise Plan, as adopted by Ordinan~ No. 606, with an amendment of Section II of subj~ t Precise Plan to include Residential use as a permitted use.
