$ 4 ? 9 10 11 14 17 I8 Z4 28 5O RESOLUTION NO. 1627 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN APPROVING VARIANCE 77-4 FOR THE PROPERTY LOCATED AT 17441 NORWOOD PARK PALCE. The Planning Commission hereby resolves as follows: 1. The Planning Commission finds and determines a. That a proper application, Variance 77-4 was filed by Mr. Paul Waterman on behalf of Mr. and Mrs. Lasylo Molnar requesting authorization to vary with provisions of the zoning ordinance. b. That a public hearing was duly called noticed and held on said application. c. That the proposed rooms addition to 17441 does exceed the maximum 40% lot coverage allowance for an R-1 lot. d. That because of special circumstances applicable to the subject property, relative to size, shape, topography, location or surroundings, a strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification, evidenced by the following findings: "The entry porch area is a connection of ~wo 6pen areas and not a livable area and should nog be considered residential land coverage." e. That the granting of a variance as herein provided will not constitute a grant of special privilege inconsistent with the limitations upon other properties' in the vicinity and district in which the subject property is situated. f. That the granting of the variance as herein provided will not be contrary to the intent of the Zoning Ordinance or the public safety, health and welfare, and said variance should be granted. g. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. h. Final development plans shall require the review and approval of the City Staff. 2. The Planning Commission hereby grants a variance as applied · for, to permit subject to the following conditions: "Further land coverage on the subject property is prohibited to include the enclosing of the atrium for interior uses.
