The Planning Commission of the City of Tustin does hereby resolve as follows: 1.. The Planning Commission finds and determines as follows: a. That an amendment to the Sign Code of the City of Tustin was properly initiated, ad- vertised, and a public hearing conducted on May 9, 1977 to add Section 7, Article 2 to the Tustin Sign Code. b. That the proposed amendment is for the purpose of assuring compliance with approved plans and specifications without causing undue hardship nor restrictions upon reliable contractors. c. The proposed amendment is categorically exempt from ~he requirements of an Environ- mental Impact Report. 2- ' 2. The Planning Commission hereby recommends to the City Council the approval of an amendment to Article 2 of the Tustin Sign Code, to read as follows: "Section 7-Assurance Bond - When ~ _ siqn contractor has been put on written notice of violations of the City Codes and Ordinances within the previous two year period the Community D~opment Director shall re- quire the posting of a bond or financial security equal to 50% of the value of the sign, to guarantee compliance with the terms and conditions of a sign permit and the requirements of the City of Tustin Sign Code. Said security shall be refunded upon inspec- tion and determination of compliance. Failure to comply'within six months of the date of permit application shall result in forfeiture of security."
