OF TENTAq'IVE TRACT tt6732
The Planning Commission of the City of Tustin does
hereby resolve as follows:
1. The Planning Commission finds and determines as
follows:
a. That a proper application, pursuant to
Ordinance ~G51, was filed by Sand Dollar
Development Inc. for the purpose of creating
a 30 lot subdivision. The property identi-
fled as being a portion of the west one-half
of lot 14, block n of A. B. Chapman Tract in
the City of Tustin, located northerly of 17th
Street abutting the easterly right-of-way line
of the .Newport Freeway.
b. That a negative declaration of Environmental
Impact has been requested and is hereby granted
~_ on the basis of site plan analysis and miti-
gating measures related to sound attenuation
of the site .
c. That the proposed map, design, and improve-
ments are consistant with applicable general
and specific plans. w
d. That the site is physically suitable for the
type and the proposed density of development.
e. That the design of the subdivision and/or the
proposed improvements are not likely to cause
substantial environmental damage or substan-
tially and avoidably injure any native flora
or fauna .
f. That the design of the subdivision and the
type of improvements is not likely to cause
serious public health problems.
g. That the design of the subdivision and the type
of improvements will not conflict with Pasements,
acquired by the public at large, where access
through or use of, property within the proposed
subdivision.
h. That the tentative tract map complies with all
requirements of the City of Tustin subdivision
Ordinance and, .City of Tustin zoning ordinance
as related to single-family (R-1) development.
i. That the discharge of waste from the proposed
subdivision into the sanitation system of
Sanitation District ~7 will not result in
violations of existing requirements of the
California Regional Quality Control Board and
the laws of the State of California.

j. .Parkland in lieu fees shall be required in
lieu of dedication of parkland in the amount
of .45 acres of land X the full cash value of
the land being developed, as determined by the
latest equalized assessment roll.
The Planning Commission hereby recommends to the
City Council the approval of Tract ~G732, subject to the
following conditions:

a. That the subject acreage contained within the
tract map be annexed to the Tustin Lighting
District, with proof of submission of appli-
cation to the County Surveyor's office required
prior to signature of the final map by the
City Engineer.
'_ b. Installation of marbelite street lights and
~' underground conduit subject to approval of
the City Engineer.
c. The installation of street trees per the ~'
City of Tustin master plan of street tree`s-.
d. Dedication of all streets as required by the
City Engineer, and dedication of access rights
to Marshall Lane from lots 3, 4, 9, and ZO
and to Carroll way from lot 30 to the City
of Tustin.
e. Provision for adequate sanitary sewer and domestic
water service to each subdivided lot and the ~
installation of a loop water system if deemed
practical by the Tustin Water Works and sub-
mission of street improvement plans for the
construction of curbs, 'gutters, sidewalks, street
lights, sewer, water, and final approval by
the City Engineer.
g. Provide for all underground utilities with no
new overhead poles to be set within o:r adjacent
to the development.
h. The construction of 5'8" masonry walls on the
tract' s perimeter with such other sound at+~enu-
ation measures as shall be required for the
property abutting the Newport Freeway.
i. The removal of the chain link fencing along
the westerly tract boundary and landscapi:lg
in accordance with the plans, specifications,
and approval of the State ~Ighway Division.
j. The submission for staff approval of precise
plot r~lans ~to indicate b~aiilding locations as
related to set back r.equixements, traffic
circulation, dri.vcway cuts. and sound attenu-
ation measures, to include required berms.

k. The payment of park land dedication in lieu
of fames as authorized by Section 6b of Ordinance '~
No. 685. ~~
1. Compliance and conformance with the development
policies as adopted by the City Council of the
City of Tustin, to include the location of
fire hydrants as required by the Fire Chief,
the equipping of each residential tin it with
' smoke detectors, and conformance with the
Uniform Building Code..,
PASSED AND ADOPTED by the Planning Commission of the
City of Tustin at a regular meeting held on the 14th day of
March, 1977.
