RESOLUTION NO. 1594
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A VARIANCE ON APPLICATION NO.
77-1 OF L. L. HENDRIX
The Planning Commission of the City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines as follows
a. That a proper application for Variance (No. 77-1)
was filed by L. L. Hendrix for a variance to permit
the construction of a four (4) unit apartment
building on an existing R-3 lot of substandard
width (50') and to vary with the 5 ft. minimum
· sideyard setback requirement at the lot located at
130 Pacific Street, Tustin, California.
b. That a public hearing was duly called, noticed and
held on said aPplication.
c. That because of special circumstances ~pl~cable
to the subject property, relative to size, shape,
topography, location or surroundings, a strict
application of the Zoning Ordinance is found to
deprive the subject property of privileges enjoyed
by other properties in the vicinity and under
identical zone classification, evidenced bv the
following findings: -
1) The property was zoned R-3 at the time of the
adoption of the Zoning Ordinance even thouah
it is only 50' in width in order to provid~ a
buffer between the C-1 and R-1 districts.
2) The property to the north and sOuth are already
developed and strict adherence to the develop-
ment standards would make it impossible for this
property to be developed.~'
d. That the granting of a variance as herein prOvided
will not constitute a grant of special privilege-
inconsistent with the limitations upon other pro-
perties in the vicinity and district in which the
subject property is situated.
e. That the granting of the variance as herein pro-
vided will not be contrary to the intent of the
Zoning Ordinance or the public safety, health and
welfare, and said variance should be granted.
f. Proposed development shall be in accordance with
the development policies adopted by the City
Council, Uniform Building Codes as administered by
the Building Official, Fire Code aS~administered
.by the Fire Chief, and street improvement require-
ments as administered by the City Engineer.
g. Final development plans shall require the review
and approval of the Community Development Director.

2. The Planning Commission hereby grants a variance, as
applied for, to permit construction of a four (4)
unit apartment building and a three car garage, the
garage building being adjacent to the north Droperty .
line without the required 5 ft. side yard, subject
to the following conditions:
ao That final development plans and construction
drawings to include landscape and irrigations,
be submitted to and approved by the Community
Development Director.
b. That the property line wall will be constructed of
slump stone or of a decorative masonry approved
by staff.
PASSED AND ADOPTED at a regular meeting of the-Planning
Commission of the City of Tustin, California, held on the 14th day
of February, 1977. .
