A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A USE PERMIT ON APPLICATION NO.
UP 77-2,. of Richard Ochiai on behalf of KYoto Nursery.
The planning Commission of the City of Tustin does
4 hereby resolve as follows:

1. The Planning Commission finds and determines as
follows:
a. That a proper application (UP 77-2) was filed
by Richard Ochiai for a Use Permit to allow a
retail nursery business for the property
located at 300 East~Main Street.

b. That a public hearing was duly called, noticed
and held on said application.
c. That establishment, maintenance and operation' of
the use applied for will not, under the circum-
stances of this case, be detrimental to the health
safety, morals, comfort or general welfare of
the persons residing or working in the neighbor-
hood of such proposed use, evidenced by the
following findings: -

1. That as a part of this' application, the
applicant is proposing property improve-
ments to a vacant storage yard that will
enhance the site.

2. The proposed use is not in conflict with
.the Tustin Area General Plan.
d. That the establishment,'maintenance and operation
of the use-applied for will not be injurious or
detrimental to the propertv and improvements in
the neighborhood of the subject property, nor tO
the general welfare of the City of Tustin, and
should be granted~
e. Proposed development shall be in accordance with
the Zoning Ordinance and the development policies
adopted by the City Council, Uniform Building
Codes as administered by the Building Official,.
Fire Code as administered by the Fire Chief, and
street improvement requirements as administered
by the City Engineer.
f. That a request for exemption from the Environmental
Impact Report procedures has been filed and
approved.
2. The Planning Commission hereby grants a Use Permit,
as applied for, to authorize ~he construction of a
temporarv facility for the relocation of Kyoto Nursery
subject '~o the following conditions:

1. ~qubmittal of detailed construction, landscape,
irrigation, parking and signinq plans for review
and approval by City Staff, and leasinq agreement
subject to the approval of the City Attorney's Offic~
2. The use is permitted only for a on'e year period
beginning with initial occupancy. Reapplication
for a Use Permit will be required for authorizatior.
beyond one year.
PASSED AND ADOPTED at a regular meeting of the Planning
