RESOLUTION NO. 1589
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN APPROVING USE PERMIT 76-33 ON APPLICATION
OF THE TUSTIN UNIFIED SCHOOL DISTRICT FOR THE CON-
STRUCTION OF A SCHOOL MAINTENANCE YARD.
The. Planning Commission of the City of Tustin does hereby resol
1. The Planning Commission finds and determines as follows:
a. That a proper application (No. UP 76-33) was filed by
the Tustin Unified School District for a Use Permit to
allow the construction and operation of a school service
and maintenance yard for the property located on Service
Road, westerly of Red Hill Avenue and northerly of. the
mainline AT&SF Railroad.
b. That a public hearing was duly called, noticed and held
on said application,
c. That the establishment, maintenance and opera~ioh of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort or general welfare of the person residing or
working in the neighborhood of such proposed use, evi-
denced by the following findings:
(1) The proposed'use is consistent with the General Plan
and Zoning District regulations for the area-
(2) The subject use will be buffered by walls and land-
scaping from adjacent residential uses.
d. That the establishment, maintenance and operation of the
use applied for will not be injurious nor detrimental to
the property and improvements in the neighborhood of the
subject property, nor to the general welfare of the City
of Tustin, and should be granted.
e. That a Negative Declaration for an Environmental Impact
Report is hereby approved on the basis of the mitigating
factor of a masonry wall on the southerly perimeter along
the flood control channel.
2. .The Planning Commission hereby grants a Use Permit as applied
for to allow the construCtion'and operation of a school set-
vide and maintenance yard oh Service Road~ subject to the
following conditions:
a. A revised site plan shall be submitted to the City,
incorporating the parking lot standards, drive aisle
widths and development standards of the City of Tustin.
b. Street.improvements including street paving, curbs,
gutters, driveways, utilities, and street trees,., to be
completed across the frontage of the proposed, develop-
ment as required bY the City Engineer.
c. Landscaping plans, to include the planting of not less
than 30 Ficus retusa nitida along the southerly peri-
meter boundary, and a 10 ft. p'lanter island along
the westerly perimeter to be planted with Cyprus
trees, and landscape screening for chain link

fencing, to be submitted to the City for review and
approval.
d. The construction of a southerly perimeter masonry wall
to be consistent with the materials used for the City
Public Works Yard masonry wall.
e. Conformance with the requirements of the National Fire
Code and Ordinances of the City of Tustin as administered
by ~he Fire Chief, to include the sprinklering of any
building exceeding 12,000 square feet, fire hydrants
located at every 400 feet along the main, fire extinguishers
and loop water main.
f. The design and construction to be performed under permit
and inspection by the Building Official of the City of
Tustin in accordanCe with all applicable City laws and
ordinances.
g. The waiver of excise building fees.
h. The provision of security measures to the satisfaction of
the Chief of Police.
i. The submission of plans for exterior lighting, to include
fixture design.
j. Entering into a cooperative agreement with the City of
Tustin for the full improvement of School Road between
Sycamore and the project site to accommodate the
increased traffic demands resulting from the site improve-
ment.
k. Conformance with the noise criteria of the Noise
~ Eiemen~ of the Tustin Area General~Plan requir-
~ ing a maximum sound level at the westerly property
line not to exceed 55 dBA durinq the hours
between 10:00 p.m. and 7:00 a.m. and 60 dBA
durin~ other hours.

The Commission further resol'¢es'that violation of'-anv

of the above conditions shall be cause for the
Commission to reconsider the Use Permit and to impose
such other conditions as shall-be necessary to assure
compatibility with adjoininq residential properties.
PASSED AND ADOPTED at a special meetinq of the City of
Tustin P~anninq Commission, held on the 31st day of January,
1977.
