RESOLUTION NO. 1581
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A VARIANCE ON APPLICATION NO.
V 76-11 TO VARY WITH THE PARKING REGULATIONS OF THE
ZONING ORDINANCE AT 1222 E. IRVINE BLVD.
The Planning Commission of the City of Tustin does hereby'
resolve as follows:
1. The Planning Commission finds and determines as follows
a. That a proper application for variance (No. V 76-11
was filed on behalf of Tustin Fiddlers, Inc. for a
variance to permit enlargement of an existing
restaurant which, by its construction will neces-
'sitate the removal of required parking stalls at
the subject property.
b. That a public hearing was duly called, noticed and
held on said application.
c. That because of special circumstances ~.6pli~cable
to the subject property, relative to size, shape,
topography, location or surroundings, a strict
application of the Zoning Ordinance is found to
deprive the subject property of privileges
enjoyed by other properties in the vicinity and
under identical zone classification, evidenced
by the following findings:
1) That parking allocation of one space per 250
sq. ft. of building area has been authorized
for various large multi-tenant developments
within the City.
2) That proposed parking plan for the subject
development is well over the minimum, based
on a 1 per 250 sq. ft. allocation.
d. That the granting of a variance as herein provided
will not constitute a grant of special privilege
inconsistent with the limitations upon other pro-
perties in the vicinity and district in which the
subject property is situated.
e. That the granting of the variance as herein pro-
vided will not be contrary to the intent of the
Zoning Ordinance or the public safety, health and
welfare, and said variance should be granted.
f. Proposed development shall be in accordance with
the development policies adopted by the City
Council, Uniform Building Codes as administered
by the Building Official, Fire Code as administer
by the Fire Chief, and street improvement require
.ments as. administered by the City Engineer.
g. Final development plans shall require the review
and approval of City staff, to include parking and
drive access on the easterly side of the structure.
2. The Planning Commission hereby grants a variance as
applied for, to permit enlargement of an existing
restaurant which, by its construction will necessitate
the removal 'of required parking stalls at the subject

property, subject to the following conditions:
a. Landscaping, irrigation and sign plans will be
required in conformance with current ordinances
and guidelines.
b. Compliance with or amendment to Fire Zone 1
classification of subject property.
PASSED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Tustin, Californi&, held on the 13th
