RESOLUTION NO. 1575
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A VARIANCE ON APPLICATION NO.
V 76-9 -OF WEBER PLYWOOD COMPANY TO VARY WITH THE
SIGN ORDINANCE
The Planning Commission of the City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines as follows
a. That a proper application for variance (No. V 76-9)
was filed by Federal Signs on behalf of Weber
Plywood Company, Inc. for a variance to permit
construction of a 160 sq. ft. ground sign to adver-
tize an existing business at 15501 Mosher Street.
b. That a public hearing was duly called, noticed and
held on said application.
c. That because of special circumstances a. pplicable
.to the subject property, relative to siz~e, shape,
topography, location or surroundings, a strict
application of the Zoning Ordinance is found to
deprive the subject property of privileges enjoyed
by other properties in the vicinity and under
identical zone classification, evidenced by the
following findings:
1) That the sign is existing in use outside the
City of Tustin and its continued use at the
new location is essential to the owner to enjoy
the full benefits of previously established
good will at this location.
2) That the size, location and shape of the
existing building on the property is such as
to make this sign compatible with the intent
of the size limitations on signs.
3) That the conditions imposed are such as to
assure that the benefits are of a limited
duration and not into perpetuity.
4) That the sign variance authorizes a single
identification sign in lieu of any other site
identification.
d. That the granting of a variance as herein provided
will not constitute a grant of special privilege
inconsistent with the limitations upon other pro-
perties in the vicinity and district in Which the
subject property is situated.
e. That the granting of the variance as herein pro-
vided will not be contrary to the intent of the
Zoning Ordinance or the public safety, health and
welfare, and said variance should be granted.
f. Proposed development shall be in accordance with
the development policies adopted by the City

Council, Uniform Building Codes as administered
by the Building Official and the Fire Code as
administered by the Fire Chief.

.g. The variance is authorized on the basis of a
finding of a hardship related to the location of a
business relocated to an area without a through
street or major arterial serving the location.
2. The Planning Commission hereby grants a variance as
applied for, to permit use of subject sign subject
to the following conditions:
a. That the sign be located not closer than 100 ft.
distance from the intersection of Valencia and
Mo'sher Street.
b. As~ an alternative to the ground based sign, the
sign may be located on the wall of the structure
with location as approved by staff.
c. That the proposed and existing sign sh~ll be
authorized for a period not to exceed 5 years, for
the purpose of amortization, with said sign
authorization to expire January 1, 19 82, after
which time the signing for the site shall conform
to the Sign Code of the City of Tustin as in effect
upon that date.

d. That sign hereby authorized shall be in lieu of
.any other identification signing for the site.
PASSED AND ADOPTED at a regular meeting of the Planning
Com~nission of the City of Tustin,' California, 'held on the 13th
day of December, 1976.
