RESOLUTION NO. 1572
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING USE PERMIT NO. 76-28 ON THE
APPLICATION OF GARETH C. DART FOR A FAMILY AMUSEMENT
CENTER
The Planning Commission of the City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines as follows
a. That a proper application No. UP 76-28 was filed
by Gareth C. Dart to authorize a family amusement
center to include pool tables, electronic games,
pin ball machines, jute box and snack bar, located
at 14551 Newport Avenue, southerly of Walnut Avenue
b. That a public hearing was duly called, noticed and
held on said application.
c. That establishment, maintenance and operation of
the use applied for will not, under the. circum-
stances of this case, be detrimental to' the health,
safety, morals, comfort or general welfare of the
persons residing or working in the neighborhood
of such proposed use, evidenced by the following
findings:.
(1) That subject use is in conformance to the
Tustin General Plan as adopted by the City
Council of Tustin; and
(2) That the development will be constructed in.'
accordance with an approved plan for the
building and site.
d. That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.
e. Proposed development shall be in accordance with
the Zoning Ordinance and the development policies
adopted by the City Council, Uniform Building
Codes as administered by the Building Official,
Fire Code as administered by the Fire Chief, and
street improvement requirements as administered by
the City Engineer.
f. That a request for exemption from the Environmental
Impact Report procedures has been filed and approve.
2. The Planning Commission hereby grants a Use Permit,
as applied for, to authorize a family amusement center
to be located within a previously constructed but never
completed structure subject to the following conditions
a. That a complete analYsis of the existing structure
shall be submitted by either an architect or
engineer incorporating any 'changes in the
structure which are contemplated in addition to
a plan showing utilization of areas.

b. That a kitchen equipment plan be submitted, and
approval by the Health Department obtained.
c.- That electrical plans be resubmitted by an
electrical engineer showing compliance with
current codes and undergrounding ordinance.
d. That plans showing the method of accomplishing
the required drainage from property at rear over
the drainage easement be submitted for review
and approval.
e. That necessary permits be obtained for all
construction, and all work be accomplished in
conformance with current codes.
f. That payment be made of the building construction
tax in compliance with Ordinance No. 559.
g. That the development of the subject property shall
be done in conformance with all applicable codes
and standards, to include the City of-Tustin
Development Standards (Resolution 73-23), the
Zoning Ordinance (Ord. 157), and the Sign
Ordinance (Ord. 684).
h. That final development plans to include plot,
elevations,' materials, landscaping, irrigation,
lighting, and signing, be submitted for review
and approval by staff.
i. Installation of street trees per the City of
Tustin Master Plan for street trees.
.j. Installation of all 'utilities underground with no
additional overhead poles to be set within the
property or adjacent to street right of way.
k. Installation of street improvements to the
approval of the City Engineer.
1. That said use shall be conducted so as not to
present a nuisance to the public or adjoining
property owner in regard to noise, litter, and
public health (odors, etc.).
PASSED AND ADOPTED at a regular meeting' of the Planning
Commission of the City of Tustin, California, held on the 22nd day
of November, 1976.
