V 76-8 OF DR. MICHAEL SUKOFF The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines as follows a. That a proper application for variance (No. V 76-8) was filed on behalf of Dr. Michael Sukoff for a variance to permit the construction of a masonry wall within the front yard set back area for the property located at 17382 Amaganset Way. b. That a public hearing was duly called, noticed and held on said application. c. Subject application is categorically exempt from an Environmental Impact Report. ... d. .That because of special circumstances applicable to the subject property, relative to size, shape, topography, location or surroundings, a strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification, evidenced by the following findings: 1) Health and safety requirements specify that a swimming pool must be protected by fencing from ~accidental access. . 2) That the shape and location of pool improvements require the intrusion of a wall or fence within' the front set back area. e. That the granting of a variance as herein provided will not constitute a grant of special privilege inconsistent with the limitations upon other pro- perties in the vicinity and district in which the subject property is situated. f. That the granting of the variance as herein pro- vided will not be contrary to the intent of the Zoning Ordinance or the public safety, 'health and welfare, and said variance should be granted. 2. The Planning Commission hereby grants a variance as applied for, to permit the construction of a masonry wall in the front yard set back area, 13" from the front property line, for the p. roperty located at 1738 2 Amaganset Way.
