RESOLUTION N0. 1566
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN RECOMMENDING TO THE CITY COUNCIL DISPOSITION
OF SURPLUS ROAD RIGHT OF WAY FOR PARCELS LOCATED AT
FIRST AND NEWPORT AND NEWPORT AND HOLT AVENUES
The Planning Commission of the City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines as follows
a. That a proper application was filed by the. Planning
. Coimnission fo~: the purpose of determining the needs
.. if any, of public right of way known as the north-
westerly intersection of Newport and First Street
and the southwesterly intersection of. Newport and
Holt Avenue as described by Exhibit "A", attached
hereto' and incorporated herein by this reference
as though set forth herein in full.
b. That the subject property should be declared excess
to the City's needs and disposed of for~p.riVate
development for the following reasons:
1) The road alignments and configuration of New
First, and Holt Avenue have been established
with approved improvement plans for their ul-
timate alignment which vacates subject area.
2) The property ~s not suitableAOr adequate for
other public purposes, such as parks or recre-
ational needs.
3) There is no known use of the property as street
right of way.
c. That pursuant to Section 8330 of the Streets and
Highways Code for the State of California, it is
possible to reserve public interest in easements
for sewer, storm drains, and utility purposes.
d. That the Commission recommends the vacation of the
easements for street purposes to the adjoining
property owners without fee.
e. Subject project is exempt from an Environmental
Impact Report on the basis of the underlying EIR
76-2.
f. That the vacation of the subject street right
of way will be in conformance with the City of
Tustin General Plan.

2. The Planning Commission, pursuant to Sections 37350
and 65402 of the Government Code, hereby recommends
to the City Council the declaration of the subject
parcels as excess to the needs of the City and its
disposition to the adjoining property owners with
the reservation ,of easements to conduct, maintain,
operate, replace, remove and renew those faci].~[ties
necessary for storm drain, sewers, and public utilities
PASSED AND ADOPTED at a regular meeting of the Planning
Co].nmission of the City of Tustin, California, held on the 8th day
