HomeMy WebLinkAboutPC RES 1554 RESOLUTION NO. 1554 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, RECOMMENDING TO THE CITY COUNCIL AN AMENDMENT TO THE ZONING ORDINANCE, ORDINANCE NO. 157, AS AMENDED BY ORDINANCE NO. 654, SPECIFYING THAT CERTAIN SENSITIVE USES SHALL BE SUBJECT TO THE REQUIREMENT OF A CONDITIONAL USE PERMIT IN THE C-1 DISTRICT, C-2 DISTRICT, C-3 DISTRICT AND THE CG DISTRICT. The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines as f¢ a) That a proper application has been initiated by the Planning Commission for an amendment to Ordinance No. 157 (The Zoning Ordinance) , to amend Sections 4.7, 4.8, 4.9 and to amend Section 4.91.2 of Ordinance No. 654 to establish permitted uses in the Commercial Districts subject to a Use Permit. b) That a public hearing was duly called, noticed and held on said application. c) There will be no adverse impact upon the 'environ- ment as a result of this amendment. d) That an amendment should be approved {or the fol ing reasons: 1) To provide consistency of the Zoning Ordinan¢ with other regulating Ordinances of the Municipal Code. 2) That the uses as listed in Section 2 of this Resolution are of a character that could create a nuisance to the adjoining and surrounding properties within the neighborhood. 3) That the opportunity for review of proposed uses and criteria for development will insure against incompatibility of land uses and protect the peace and quiet of the neig by means of designating hours of operation, sound control, lighting, fire hazards, identi- fication of restricted occupancy, satisfaction of parking requirements, physical security, and the protection of life and property. 2. The Planning Commission hereby recommends to the City Council approval of the following amendments to Ordinance No. 157, as amended by Ordinance No. 654: Section 1. Section 4.7 of Ordinance No. 157, Column 2, paragraph 5 is amended to read as follows:- 4 Launderettes, mortuaries, theaters, massage · establishments, figure model studios, adult book · stores and other 6scs which in the opinion of the Planning Commission, are of a similar-nature. · Section 2. Section 4.8 of Ordinance No. 157, Column 2, Paragraph 5 is amended to read as follows: . . Animal hospitals, auto repair shops, drive-in -9 10 11 14 15 16 17 I8 19 Z0 Zl 25 26 28 29 50 51 establishments when of a type of use~indicated, cleaning and dying establishments, laundrys, · launderettes, second-hand sales, outdoor markets, outdoor kales establishments, pet shops, ~otels, hotels, massage establishments, figure model studios, adult book stores, rest homes, public garages, ... used car sales lots, and other uses of a similar nature. Churches, schools, public. Section 3. · Section 4.9 of Ordinance No. 157, Column 2, Paragraph 6 s amended to read as follows: Outdoor sales establishments, second-hand sales, motels, massage establishments, figure model studios, adult book ~tor~s, light manufacturing, including manufacturing of clothing, novelties, and toys and uses which in the opinion of the Planning Commission are of similar nature. · Section 4. Section 4.91.2 of Ordinance No. 654 is amended to read as llows: 1 4 § 6 ? 8 9 10 11 15 15 I8 19 Z0 Zl Z4 50 51 .2 Permitted uses subject to use permit. · The following additional uses are permitted in the CG District subject to approval of a use permit: .21 Amusement and recreation facilities. .22 Any development in excess of five (5) acres in total parcel size. .23 Automobile vehicle sales. .24' Automobile supplies.and services, .25 Bakeries, wholesale. .26 Billiard parlors and pool halls. .27 Bowling alley. .28 Building supply. .29 Business school. .210 Churches, Schools, and public places of assembly .211 Cleaning and laundry establishments (on premise . · 212 Clubs. .213 Drive-In and Take-Out establishments for food or services. .~214 Fraternal organizations a~d lodge. · 215 Health clubs, massage establishments, figure ~odel studios, and gymnasiums. .216 Manufacturing, fabrication, distribution facilities occupying less than 50% of floor area and less than 50%operations. .217 Mortuaries. .218 Motels and hotels. ~219 Nursery schools. .220 Outdoor markets and sales establishments. .221 Pet shops. .222 Rest homes and convalescent hospital facilities.
