RESOLUTION NO. 1553
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN RECOMMENDING AMENDMENT TO LAND USE ELEMENT
OF THE GENERAL PLAN RELATIVE TO THE EASTERLY SIDE OF
HOLT AVENUE, NORTHERLY OF IRVINE BLVD. AND SOUTHERLY
OF THE FLOOD CONTROL CHANNEL
The Planning Commission of the City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines as follows:
a. That Section 65356.1 of the Government Code of the
State of California provides that when it is deemed
to be in the public interest, the legislative body
may amend a part of the General Plan.
That in accordance with Section 65356 of the
Government Code of the State of California, a publi
hearing was duly advertised and held o~' September
13, 1976 on the application of the property owners
within the area, as initiated by Pat Koval, 17742
Irvine Blvd. to consider General Plan Amendment
76-2(C) to reclassify the properties, which are in
the unincorporated area of Tustin's Sphere of
Influence, to Multi-family residential use. The
hearing was continued until September 27, 1976.
b. That an Environmental Impact-Report for the re-
quested change was prepared and recommended by the
Planning Commission on September 13, 1976 to the
City Council for certification.
c. That the highest and best use of the land would be
for Multi-family Residential use of not more than
one dwelling unit per 3,000 sq. ft. of land area.
d. That the change in classification would be in the
public interest and not detrimental to the welfare
of the public or the surrounding property owners.
2. The Planning Commission hereby recommends to the City
Council approval of General Plan Amendment 76-2 (C),
amending the Land Use Element to reclassify the pro-
perties easterly of Holt Avenue, northerly of Irvine
Blvd., and southerly of the flood control channel,
which are in the unincorporated area of Tustin's Sphere
of Influence to Multi-family Residential use with the
following conditions:
a. That the density of the residential development be
not more than one dwelling unit per 3,000 sq. ft.
of land area.
b. That existing structures on the properties not be
converted to Multi-family use and that they be re-
moved prior to the issuance of a building permit
for the construction of any multi-family dwelling
units.
