RESOLUTION NO. 1552
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A CONDITIONAL USE PERMIT ON APPLI-
CATION NO. U.P. 76-21, OF PACIFIC COAST FARMERS MARKET
The Planning Commission of the City of Tustin does hereb
resolve as follows:
1. The Planning Commission finds and determines as follows
a. That a proper application (No. U.P. 76-21) was
filed on behalf of Pacific Coast Farmers and J.
Moranda for a Conditional~ Use Permit to allow
a take-out sandwich shop in conjunction with a
produce market in an existing shopping center
located at 12991 Newport Avenue.
b. That a public hearing was duly called, noticed
and held on said application.
c. That establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental, t6 'the
health, safety, morals, comfort or general
welfare of the persons residing or working in
the neighborhood of such proposed use, evidenced
by the following findings:
1. There is an existing shopping center on the
property which contains a restaurant and
several commercial activities.
2. There will be no eating on the premises and
therefore no increase in parking requirements.
d. That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.
e. Proposed development shall be in accordance with
the Zoning Ordinance and the development policies
adopted by the City Council, Uniform Building Codes
as administered by the Building Official, Fire
Code as administered by the Fire Chief, and street
improvement requirements as administered by the
City Engineer.
f. That the subject request is categorically exempt
from the requirements of filing an Environmental
Impact Report.
2. The Planning Commission hereby grants a Use Permit,
as applied for, to allow a take-out sandwich shop i.~
connection with a produce market in an existing
shopping center at 12991 Newport Avenue, subject to
the following condition:

a. That all food served shall be for take-out only
and that no food be served for eating on the
premises.
PASSED AMD ADOPTED at a regular meeting of the Planning
Commission of the City of Tustin, California, held on the 11th
day of October, 1976.
