C 1 RESOLUTI O:1 .NO . 15 42 - 2 A RESOLUTION OF THE PLAN'_~TING C01~.;42SSION OF THE 3 CITY OF TUSTIN RECOP~~iENDING APPROVAL OF TENTATIVE PARCEL PSAP NO: 76-85 4 5 The Planning Commission of the City of Tustin does hereby ~ 6 resolve as follows: 7 '1. The Planning Commission finds and determines as follows: 8 a. That Tentative Parcel Map No. 76-85 was submitted to the Planning Commission pursuant to the Sub- 9 division Ordinance No. 651 by the John S. Griffith Company on behalf of Thrifti-Mart for the purpose 10 of creating five (5) parcels from two existing parcels as indicated on Book 401, Page 29, Block 11 2, Parcels 1 & 2, Records of Orange County with the properties bordered by First Street on the south, 12 -Holt Avenue on the east, Irvine Boulevard on the -north and Newport Avenue on the southeast. ~13 b. That said Parcel P~'Iap is in conformance with the 14 Zoning Ordinance and the General Plan for the City of Tustin and the application is in conformance _ . 15 -with the requirements of Ordinance No. 651 of the ' City of Tustin. 16 _. c. That an underlying EIR for the subject property was 17 certified by the Planning-Commission on July 12, :~_ 1976. 18 ' 2. The Planning Commission hereby recommends to the City a•g ~ .Council the approval of Tentative Parcel Map No. 76-85 subject to the following conditions: 20 ~a. That street vacation proceedings be initiated and 21 the areas of public right of way contained in proposed Parcels 4 and 5 be acquired by the 22 developer prior to submittal of the Final Parcel. Map 23 b. That Parcels 4 and 5 be combined as one parcel. .,24 ' c. That all access rights to Newport Avenue be • dedicated to the City of Tustin. f. That portions of land within the Parcel Map boundary not already within the Tustin Lighting .District be anne;~ed to said District. Filing of annexation must be initiated prior to City Engineer approval of Final Map. g. That marbelite street lights and underground conduit be installed on all public street frontages to the satisfaction of the City Engineer. h. That on site drainage facilities be constructed to the satisfaction of the City Engineer to convey all roof water and surface drainage to an approved ' storm drain. i. That any missing or damaged curbs, gutters, sidewalks and drive aprons be•installed as directed by the '. City Engineer. j. That all utilities be installed underground with no new poles installed wither on-site or adjacent tb~the development. k. That 10 f t. wide strip of land adjacent to Irvine Boulevard be offered for dedication for road and utility purposes with the appropriate corner cutoff at Holt Avenue. 1. That street trees be installed in accordance with the City's Master Plan of Street Trees. . m. No structure shall intrude into any setback area as measured from the ultimate right.of way line. - n. All previous conditions of Use Permit No. 76-14 be applicable to the subject Parcel Map. - o. That conditions a, b, c, d, e, _ f and k~= be satisfied prior to the submission of the Final Parcel Map.
