RESOLUTION NO. 1533
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CALIFORNIA GRANTING A VARIANCE ON APPLI-
CATION NO. V 76-5 OF GENE KING
The Planning Com~aission of the .City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines as follows:l
a) That a proper application for variance (No. 76-5) ·
was filed on behalf of Gene King for a variance to
permit the construction of a six (6) unit apart-
ment building on an existing R-3 lot of substandard
width (50'), located at 130 Pacific Street, Tustin,
Ca.
b) That a public hearing was duly called; noticed and
held on said application.
c) That because of special circumstances applicable
to the subject property, relative to size, shape,
topography, location' of surroundings, a strict
application of the Zoning Ordinance is found to
deprive the subject property of. privileges enjoyed
by other properties in the vicinity and under
identical zone classification, evidenced by the
following findings:
1) The property was zoned R-3 at the time of the
-_.: adoption bf th~_Zoning. Ordinance. even though
it is only 50' in width in order to provide a
buffer between the C-1 and R-1 districts.
2) The property to the north and south are already
developed and strict adherence to the dev~lo
ment standards would make it impossible for thi
. property to be developed.
d) That the granting of a variance as herein provided
will not constitute a grant of special privilege
inconsistent with the limitations upon other pro-
perties in the vicinity and district in which the
subject property is situated.
e) That the granting of the variance as herein pro-
vided will not be contrary to the intent of the
Zoning Ordinance or the public safety, health and
welfare, and said variance should be granted.
f) Proposed development shall be in accordance with
the development policies adopted by the City.
Council, Uniform Building Codes as ·administered by
the Building official, Fire Co·de as administered
by the Fire Chief, and street improvement require-
ments as administered by the City Engineer..
g) Final development plans shall require the review a
approval of the Community Development Director.

The Planning Commission hereby grants a variance as
applied for, to permit construction of a six unit
apartment building and a twelve car carport and laund]
building, the carport and laundry building being ad-
jacent to the north property line without the requireG
5' side yard, subject to the following conditions:
a)
That final development plans be submitted to and
approved by the Community Development Director.
b)
That the carport wall adjacent to the north pro-
perty line be constructed of slump stone or equiva-
lent masonry construction.
PASSED AND ADOPTED at a regular meeting .of the Planning
2ommission held on the 9th day of August,. 1976.
