RESOLUTION NO. 1528
A RESOLUTION OF THE PLANNING. COMMISS-~ON OF THE•CITY
OF TUSTiN GRANTING A USE PERMfT ON APPLICATION N0.
UP 76-14, of JA~'~ S. GRIFFITH ~ CO.
The Planning Commission of the City of Tustin does hereby resolve
as follows: -
1. The Planning Commission finds and determines as follows: -
a. That a proper application UP 76-14 was filed on behalf of
- John S. Griffith ~ Co. for a Use Permit to authorize the
construction of a shopping center for the property bounded
on the east by Holt, north Irvine Blvd. and south by
First Street.

b. .That a public hearing was duly called, noticed and he]d on
said application. - •
c. That establishment, maintenance and operation of the use' _
applied fot- wi 11 not, under the c i rcumstances of th i s case, •
be detrimental to the health, safety, morals, comfort or
general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the following
findings. The subject site is designated by the General Plan
and Zoning Ordinance for the uses as proposed. -
d. That the establishment, maintenance and operation of the us
applied for will not be injurious or detrimental to the
property and improvements in the neighborhood of the subject
. property, nor to the genera l• welfare of the .City of Tustin,
and shout d be granted. - •
e. Proposed development shall be in accordance with the Zoning
Ordinance and the development policies adopted by the City
Council, Uniform Building Codes as administered by the
Building Official,. Fire Code as administered by the Fire
Chief, and street improvement requirements as administered
by the City Engineer, and as contained in Planning Commission
Report dated July 12, 1976. - -
f. That an Environmental Impact Report has been filed and
certified (E I R 76-2~ for subject project.
2. The Planning Commission hereby grants a Use Permit, as applied
for, to al lo,,,r• the- construction of a shopping center on a .11 .2
acre parcel bounded by Irvine Boulevard, Newport Avenue, Holt
Avenue and First Street in accordance with the plans as
submitted and filed with the City of Tustin subject to the
following conditionse
a. Evidence of title-and building rights shall be furnished
the City prior to the issuance of building permits for any
portion of subject development.
b. The project shall be developed in phases with the requirement
for resubmission and approval of the Planning Commission for
Phase II of the project consisting of the Bank-site and
proposed restaurant with parking accommodations, without
the necessity. of public hearing.

c. Parking lot design, traffic circulation, landscaping,

subject to staff approval and subject to substantial

PASSED AND ADOPTED at a regular.meeting of the Planning Commission,
