(The meeting will convene immediately following the adjournment of the Regular Meeting of the City Council) CALL TO ORDER -Meeting #2 ATTENDANCE PUBLIC INPUT CONSENT CALENDAR ITEMS {Agenda Items 1-4) 1. APPROVAL OF MINUTES -SPECIAL MEETING OF THE SUCCESSOR AGENCY TO THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY HELD ON FEBRUARY 21, 2012 Recommendation: That the Successor Agency to the Tustin Community Redevelopment Agency approve the Action Minutes of the Special Meeting of the Successor Agency to the Tustin Community Redevelopment Agenda held on February 21, 2012. 2. FIRST AMENDMENT TO REGULATORY AGREEMENT AND DECLARATION OF RESTRICTIVE COVENANTS AND FIRST AMENDMENT TO SUPPLEMENTAL REGULATORY AGREEMENT FOR THE TUSTIN LEGACY COVENTRY COURT PROJECT Authorization is requested for amendments to the Regulatory Agreement and Supplemental Regulatory Agreement for the Tustin Coventry Court Project at Tustin Legacy with Tustin Coventry Seniors, LP. NOTE; As required by Senate Bill 343, any non-confidential writings or documents provided to a majority of the Successor Agency to the Tustin Community Redevelopment Agency members regarding any item on this agenda will be made available for public inspection in the City Clerk's office located at 300 Centennial Way, Tustin, CA during normal business hours. Recommendation: It is recommended that the City Council Acting as the Successor Agency to the Tustin Community Redevelopment Agency approve and authorize the Executive Director, or his designee, to execute the First Amendment to Regulatory Agreement and Declaration of Restrictive Covenants. 3. AGREEMENT BETWEEN THE CITY AND SUCCESSOR AGENCY FOR ADMINISTRATIVE SUPPORT PURSUANT TO HEALTH AND SAFETY CODE SECTION 34171 AND SUCCESSOR AGENCY APPROVAL OF AN ADMINISTRATIVE BUDGET PURSUANT TO HEALTH AND SAFETY CODE SECTION 34177 (j) Successor Agency Approval is requested of an Administrative Budget and authorization for the City and Successor Agency to enter into an agreement for administrative support and reimbursement for such services. Recommendation: It is recommended the City acting as the Successor Agency to the Tustin Community Redevelopment Agency ("City Successor Agency") take the following actions: 1. Adopt Resolution No. 12-04 approving an Administrative Budget pursuant to Galifornia Health and Safety Code Section 34177 (j). 2. Approve and authorize the Successor Agency to enter into an Agreement for Reimbursement of Costs and City/Successor Agency Operations Loan with the City for reimbursement of costs incurred by the City to support Successor Agency operations and obligations consistent with the Administrative Budget approved by the Successor Agency. The Successor Agency shall also be authorized to enter into any agreements necessary to provide administrative support services as identified in the Administrative Budget attached hereto. (Note that the above actions by the City Successor Agency shall not become effective for three business days, pending any request for review by the California Department of Finance (DoF). If DoF requests review of the City Successor Agency action, it shall have 10 days from the date of its request to approve the City Successor Agency action or return it to the Board far reconsideration, and the action, if subject to review by DoF, shall not be effective until approved by DoF). SUCCESSOR AGENCY TO THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY RESOLUTION NO. 12-04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ACTING AS SUCCESSOR AGENCY TO THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY ADOPTING AN ADMINSTRATIVE BUDGET PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE SECTION 34177 OF PART 1.85 OF THE DISSOLUTION ACT 4. DELEGATION OF AUTHORITY FOR MODIFICATIONS TO THE Successor Agency to the Tustin Community Redevelopment Agency March 20, 2012 Regular Meeting Agenda Page 2 of 3 ENFORCEABLE OB[_IGATIONS PAYMENT SCHEDULE OR RECOGNIZED OBLIGATION PAYMENT SCHEDULE Approval is requested to authorize certain ofFcials of the Successor Agency to the Tustin Community Redevelopment Agency ("City Successor Agency") to make any augmentation, modification, additions or revisions as may be necessary to any Enforceable Obligations Schedule (FOPS) or Recognized Obligation Payment Schedule (BOPS) approved by the City Successor Agency and Oversight Board. Recommendation: Approve City Manager and/or Director of Finance as delegated officials of the City Successor Agency as authorized to make any augmentation, modification, additions, or revisions as may be necessary to the FOPS or ROPS based on review by the California Department of Finance ("DoF") or the County of Orange's selected independent auditor in the case of the ROPS.
