A F.ESOLUTION O:~' THE PLANNI~IC~ Cnr~MISSION OF THE CITY
OF TUSTIN GRANTING A CONDITIONAL USE PERMIT ON
APPLICATION NO. UP 76-9 f}F THE TUSTIN t~7ATER t~iORKS
The Planning Commission of the City of Tustin does hereb~T
resolve as follows: ~~
1. The Planning Commission finds and determines as follows:f
a. That a proper application (No. UP 76-9) was .filed
on behalf of the Tustin t~Iater t~TOrks for a condit? on-
al use permit to allow the construction and overa-
tion of a well site northerly of Beneta t~Tay within
the boundaries of the Columbus Tustin Park Site.
b. That a public hearing was duly called, noticed and
held on said application. -
c. That a negative declaration has. been filed and is
hereby .approved for -the proposed construction and
operation of the well.
d.
That the establishment, maintenance and o_eration of
the use applied for will not, under the circumstance
of this case, be. detrimental to the health, safety,
morals, comfort or general welfare of the persons
residing or working in the neighborhood of such
proposed use, evidenced by the findings that the
supply of water to existing residential developments
is a necessary public service and that the~con- -~
struction and design, and maintenance of. such facil-
ities are such as to mitigate against any adverse
impacts upon adjoining property owners and the publi
at 1 arge . .
e. That the establishment., maintenance and operation
of the use applied for Grill not be injurious or
detrimental to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin, and should-
. be granted.
f. That the proposed development shall be in accord-
ance caith the ordinances and guidelines for the
develo~mert as adopted by the Citv Council.
2. The Planning Commission hereby grants a Use Permit as
applied for to allow the construction and operation of
a water well northerly of Beneta t~Tav on the easterly_
boundary o.f the Columbus Tustin Park Site, subject ~ to
the following conditions:
a. Approval by the Orange County Flood Control District
and completion of negotiations with the City. of
Tustin.
b. The construction of security fencing for eaui~ament
and t~.ell site during c'.rillir:q and con5truc~.ion.
