CITY OF TUSTIN GR.AiJTI;. G A USE PERMIT ON APPLICATIOLV NO. U . P . 76 -5 , OF r~IARIE CALLENDER VENTURES , INC . The Planning Commission of the City of Tustin does here resolve as follows: ~. 1. The Planning Com~:ission finds and determines as follows a) That a proper application (No . U . P . 76-5 ) was fil~~.~~' on behalf of Marie Callender Ventures, Inc, for a Use Permit to authorize the construction and oper. ~- ation of a restaurant and cocktai 1 lounge accom- modating 225 seats with 110 parking spaces in th~~. Commercial General District on the property loc--% on the northwesterly lot at First and Myrtle 5~:.- b) That a ~ public hearing taas duly called, ` notice: held on said application c) That establishment,'maintenance and operation of. . the use applied for will not,. under the circum- stances of this case, be detrimental to the healf~'r safety, morals, comfort or general welfare .of th~~ persons residing or working in the neighborhood such proposed use, .evidenced by the following findings: 1} -The use is in conformance with the Tustin A ,~ General Plan. 2 ) The use is in .compliance with the zoning regu~- la-~ions for the district. 3) The site i s remote from residential developm=~~ ~. !w and would cause no adverse impact upon the :=- . ~- joining developments. . d) That the establishment, maintenance and operatio~~~: of the use applied. for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor_ to .the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance with the development policies adopted by the City . Council, Uniform Building Codes as administered . by the Building Official, Fire Code as administered by the Fire Chief, and street improvement require- . ments as administered by the.
