A RESOLUTION OF THE CITY OF TUSTIN PLANNING CO~IMISSIOIV
RECOriMENDING APPROVAL Oh' AN AMENDMENT TO THE LAND USE
Ai1D OPEN SPACE ELEMENTS OF THE TUSTIN AREA GENERAL PLAN
FOR THE PEPPERTREE SUBDIVISION
The Planning Commission of the City of Tustin-.does hereby
resolve as follows:
1. The Planning Commission finds and determines as
follows
! a. That the Irvine Company has filed a proposed
amendment to the Tustin Area General Plan to
authorize the conversion of Lot 116 of Tract 7813
from proposed school site and open space to
Planned Community Residential to authorize the
construction of single-family residences.
b. That the Tustin Unified School District has by
. action of the board, declined to exercise their
option to purchase and develop the subject property
as a school site.
c. That as a mitigating factor, the Irvine Company
has offered to dedicate an additional .65 acres of
park .land and construct two of proposed. three
tennis courts on the site.
d. That the Planning Commission did, by Resolution
No. 1467, recommend to the City Council the
certification of EIR ?5-2 for the proposed project.
e~. That a public hearing was duly advertised and
held on subject amendment.
f. That there are extenuating circumstances related to
the proposed amendment whereby the ultimate
.development of the neighborhood could not material-
ize as planned due to the deletion of the proposed
school site.
2..-The Planning Commission hereby recommends to the City
Council approval of the proposed amendment to the Land
Use and Conservation, Open Space and Recreational
Elements of the General Plan as related to the Planned
Community District Regulations of the Peppertree
Neighborhood,. subject to the following conditions:
a. Single-family residential development of subject
parcel shall be subject to the requirements of the
Planned Community District Regulations as adopted
by City Council Ordinance No. 528.
b. The location and configuration of public and.
private developments shall be subject of approval
in conjunction with. the approval of related tract
maps.

c. A total of not less than four acres of
park land and open space shall. be required
for dedication to serve the Peppertree
_ Neighborhood with said hark land to be
developed bar the construction of three
tennis courts on land in addition to that
. presently i_-~proved for park use, too of
which shall be fully improved at no
expense to the Citv of Tust?n:
