RESOLUTION NO. 1459
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN RECOMMENDING AMENDMENT TO ORDINANCE NO. 611
FOR THE CONDITIONS OF ZONE CHANGE NO. 73-6
The Planning Commission of the City of TuStin does here~·
resolve as follows:
1. 'The Planning Commission finds and determines as
follows:
a. That a proper application (Amendment to ZC No.
73-6') has been filed on behalf of the Atchison,
Topeka & Santa Fe Railway Co. by M. W. Lloyd,
Assistant Secretary for the purpose of amending
rules and regulations for rail operations serving
the Tustin-Irvine Industrial Complex easterly of
proposed Jamboree Road.
b. That a public hearing was duly cai--led, noticed
and held on said application;
c. That the proposed amendment shall be adopted for
the following reasons:
(1) The amendment substitutes performance
standards for arbitrary terms and conditions
for railroad operations.
(2) The interest of the public is protected
against adverse factors of noise and in-
convenience.

(3) The proposed amendment enables efficient and
orderly rail operations to the tenants of
the industrial complex.
(4) The proposed amendment is in accordance with
the intent and procedures of Public
Utilities Co~-unission General Order No. 135.
d. The proposed amendment is exempt from an
Environmen.tal Impact Report on· the basis of an
underlying EIR having been certified in con-
junction with Zone Change 73-6.
e. Said proposal is in conformance with the Noise
Element of the Tustin Area General Plan.
2. The Planning Commission hereby reconunends to the City
Council an amendment to para. 6 of Ordinance No. 611,
approving Zone Change 73-6, to read as follows:
"Rail operations shall be conducted so as not to
exceed 55 dB(A) for any instance between the hours
of 10 p.m. and 7:00 a.m:, and the Walnut Avenue
crossing shall be opened and unobstructive for ~
vehicle traffic between the hours of 6:30 a.m. to
9:00 a.m. and 3:30 p.m. to 6:00 p.m., except for
urgency rail operations and then not to exceed a
continuous period of more t/~an five minutes."
